MINUTES OF THE MEETING OF THE STEERING COMMITTEE OF MACP HELD ON 11/12/2014
4th meeting of the steering committee of the MACP on promotional hierarchy was held on 11/12/2014 at CPWD Engineers Association Office, IndraPrastaBhawan, New Delhi to discuss the legal/financial aspect on defending/intervening the SLPs filed in Supreme Court of India.

Briefing the functioning of the Steering Committee since its formation on 25/09/2014, the Convener of the Steering Committee has said that the Steering Committee has decided to intervene in the SLP filed against granting of MACP on promotional hierarchy by the Government against Shri M V Mohanan Nair (CAT Ernakulam), Shri Babu Ram, Smt Reeta Devi & Shri Dhirender Singh (CAT Chandigarh).The date of the case of Shri Mohanan Nair was listed as 08/10/2014 whereas the date of listing of Shri Babu Ram, Reeta Devi & Dhirender Singh is yet to be posted in the Supreme Court web site.As regards the engagement of advocates to defend the SLPs, the convener has said that Shri M V Mohanan Nair has engaged Justice Giri and Shri Babu Ram, Dhirender Singh and Smt Reeta Devi have engaged Adv O P Badhani to present their side.
Moreover, all India CPWD Engineers Association, National Federation of Atomic Energy Employees & CPWD Engineers Association have engaged advocates to file application for intervention in the case. Similarly, Shri Sanjay Kumar whose case is pending in the Delhi High Court has also decided to file an application before the Supreme Court in order to intervene in the case.
Leaders representing various Associations/Unions addressed the meeting and asked the Steering Committee to take the challenge very seriously and all possible efforts should be taken to resolve the issue positively and the case should properly be coordinated.
While discussing collection of funds to meet the expenses of the legal action, Convener of the Committee has said that Shri Mohanan Nair of CAT Ernakulam was not interested to go with the case because he was not in a position to bear the expenses of the senior advocate to be appointed to present his side. But following the formation of this SteeringCommittee at National level, some of the Central Government Employees under the leadership of Shri Harilal and Srikumar of MES come in support of Shri Mohanan Nair and has raised funds by collection from the affected Central Government Employees to meet his legal charges. But,  for  Babu Ram, Reeta Devi & Shri Dhirender Singh of Chandigarh have to be funded by this SteeringCommittee as these are low paid employees and they have no source of income to bear the legal expenses, the Convener said. The SteeringCommittee discussed the matter and unanimously decided to arrange financial support to Babu Ram, Reeta Devi & Shri Dhirender Singh to meet the legal expenses.

Thereafter, collection of contributionto meet the expenses of legal charges has been discussed and the representatives of the Associations present in the meeting voluntarily gave consents to give funds. Consents from 15 Associations viz. Census EDP Staff Association, Survey of India Group B Officers Association, IBM Administrative Staff Association, All India Central Ground Water Board Employees Association, Survey of India Ministerial Staff Association, All India Statistical Investigators Association, Statistical Officers Association, Akashwani-Doordarshan Camera man Association, Postal Engineers Association, All India Archeological Survey of India Employees Association, IMD Administrative  Staff Association, CPWD Assistant AD Association, All India CPWD Staff Association, All DDA Engineers Association,  Shri D P Sing &V M Tripathi of AIR, have been given to contribute Rs. 7,60,000. The representative of All India MES Civil Engineers Association has said that decision regarding contribution will be intimated to the Steering Committee by next meeting. Shri P S Prasad of Karnataka COC has said his COC will consider payment of contribution on receipt of a request letter on the matter from the Steering Committee.

It was also decided that no contribution will be paid in the form of cash and the amount need not be paid to the Steering Committee. The Associations have to pay contribution for which they have given consents in the meeting in the form of crossed cheque to the Advocates directly as per the directions of the Steering Committee under intimation to the Steering Committee.

The meeting has authorized the Convener to contact all Associations which are in the mailing list of the Steering Committee to obtain their consents in connection with payment of contribution.

PROGRAMME OF ACTION

ORGANISE STATE/DISTRICT/DIVISIONAL LEVEL CONVENTION TO POPULARIZE THE DECLARATION BEFORE FEBRUARY 2015

TO ORGANISE MASSIVE DHARNA/RALLY AT ALL STATE CAPITAL/MAJOR DEFENSE CENTERS JOINTLY BY ALL PARTICIPATING UNIONS IN MARCH 2015

TO ORGANISE CAMPAIGN FORTNIGHT THROUGH OUT THE COUNTRY IN THE FIRST TWO WEEKS OF APRIL 2015.

TO ORGANISE RALLY BEFORE THE PARLIAMENT HOUSE IN THE MONTH OF APRIL WHEN THE HOUSE WILL BE IN BUDGET SESSION TO DECLARE THE DATE FOR THE COMMENCEMENT OF INDEFINITE STRIKE ACTION AND THE PROGRAMME AND DATE OF SERVING STRIKE NOTICE

As per the decision of the JCM National Council Staff Side, a massive National convention of all Central Government Employees including Railways, Defence and Confederation was held at MPCU Shah Auditorium, New Delhi on 11.12.2014. About 800 delegates from various parts of the country participated. Convention was presided by Com. Rakhal Das Gupta (AIRF) Shri Guman Singh (NFIR) Com. S. N. Pathak (AIDEF) Shri Ashik Singh (INDWF) Com. K. K. N. Kutty (Confederation), Com. GiriraJ Singh (NFPE) and Shri Devendera Kumar (FNPO). Com. M. Raghavaiah, Leader, JCM NC Staff Side & General Secretary, NFIR delivered his opening address. Com. Shiv Gopal Mishra, Secretary, JCM NC Staff Side & General Secretary, AIRF presented the draft declaration and also addressed the delegates. In addition to the leaders mentioned above Com. S. K. Vyas (Advisor, Confederation) Com. C. Sree Kumar (Secretary General , AIDEF) Shri. R. Srinivasan (Secretary General, INDWF) Com. M. Krishnan (Secretary General, Confederation), Com. R. N. Parashar (Secretary General, NFPE) also addressed the convention. Com. K. K. N. Kutty, president, Confederation summed up the deliberations. The declaration presented was adopted unanimously with certain modifications. The charter of demands and programme of action was also approved by the convention unanimously. CHARTER OF DEMANDS
1. Effect wage revision of Central Government Employees from 1.1.2014 accepting the memorandum of the staff side JCM; ensure 5- year wage revision in future; grant interim relief and merger of 100% DA. Ensure submission of 7th CPC report with the stipulated time frame of 18 months; including Grameen Dak Sewaks within the ambit of the 7th CPC. Settle all anomalies of 6th CPC.

2. No Privatisation, PPP or FDI in Railways and defence establishments and no corporatisation of postal services.

3. No Ban on recruitment/Creation of posts.

4. Scrap PFRDA Act and re-introduce the defined benefit statutory Pension scheme.

5. No Outsourcing; Contractorisation, privatisation of Governmental functions; withdraw the proposed move to close down the printing presses; the publication, form store and stationary departments and Medical Stores depots; regularize the existing daily rated/casual and contract workers and absorption of trained apprentices;

6. Revive the JCM functioning at all levels and an effective negotiating forum for settlement of the demands of CGEs.

7. Remove the arbitrary ceiling on compassionate appointments.

8. No labour reforms which inimical to the interests of the workers.

9. Remove the Bonus ceiling;


10. Ensure 5 promotions in the service career.
