THE MEETING OF THE STEERING COMMITTEE OF MACP HELD ON 11/12/2014
4th meeting of the steering
committee of the MACP on promotional hierarchy was held on 11/12/2014 at CPWD
Engineers Association Office, IndraPrastaBhawan, New Delhi to discuss the
legal/financial aspect on defending/intervening the SLPs filed in Supreme Court
of India.

Briefing the functioning of
the Steering Committee since its formation on 25/09/2014, the Convener of the Steering Committee has said that the Steering
Committee has decided to intervene in the SLP
filed against granting of MACP on promotional hierarchy by the Government
against Shri M V Mohanan Nair (CAT Ernakulam), Shri Babu Ram, Smt Reeta Devi
& Shri Dhirender Singh (CAT Chandigarh).The date of the case of Shri
Mohanan Nair was listed as 08/10/2014 whereas the date of listing of Shri Babu
Ram, Reeta Devi & Dhirender Singh is yet to be posted in the Supreme Court
web site.As regards the engagement of advocates to defend the SLPs, the
convener has said that Shri M V Mohanan Nair has engaged Justice Giri and Shri
Babu Ram, Dhirender Singh and Smt Reeta Devi have engaged Adv O P Badhani to
present their side.
Moreover, all India CPWD
Engineers Association, National Federation of Atomic Energy Employees &
CPWD Engineers Association have engaged advocates to file application for
intervention in the case. Similarly, Shri Sanjay Kumar whose case is pending in
the Delhi High Court has also decided to file an
application before the Supreme Court in order to intervene in the case.
Leaders representing various
Associations/Unions addressed the meeting and asked the Steering Committee to
take the challenge very seriously and all possible efforts should be taken to
resolve the issue positively and the case should properly be coordinated.
While discussing collection
of funds to meet the expenses of the legal action, Convener of the Committee
has said that Shri Mohanan Nair of CAT Ernakulam was not interested to go with
the case because he was not in a position to bear the expenses of the senior
advocate to be appointed to present his side. But following the formation of
this SteeringCommittee at National level, some of the Central Government
Employees under the leadership of Shri Harilal and Srikumar of MES come in
support of Shri Mohanan Nair and has raised funds by collection from the
affected Central Government Employees to meet his legal charges. But, for Babu Ram, Reeta Devi & Shri Dhirender
Singh of Chandigarh have to be funded by this SteeringCommittee as these are
low paid employees and they have no source of income to bear the legal
expenses, the Convener said. The SteeringCommittee discussed the matter and
unanimously decided to arrange financial support to Babu Ram, Reeta Devi &
Shri Dhirender Singh to meet the legal expenses.
Thereafter, collection of
contributionto meet the expenses of legal charges has been discussed and the representatives
of the Associations present in the meeting voluntarily gave consents to give
funds. Consents from 15 Associations viz. Census EDP Staff Association, Survey
of India Group B Officers Association, IBM Administrative Staff Association,
All India Central Ground Water Board Employees Association, Survey of India
Ministerial Staff Association, All India Statistical Investigators Association,
Statistical Officers Association, Akashwani-Doordarshan Camera man Association,
Postal Engineers Association, All India Archeological Survey of India Employees
Association, IMD Administrative Staff
Association, CPWD Assistant AD Association, All India CPWD Staff Association,
All DDA Engineers Association, Shri D P
Sing &V M Tripathi of AIR, have been given to contribute Rs. 7,60,000. The representative
of All India MES Civil Engineers Association has said that decision regarding contribution
will be intimated to the Steering Committee by next meeting. Shri P S Prasad of
Karnataka COC has said his COC will consider payment of contribution on receipt
of a request letter on the matter from the Steering Committee.
It was also decided that no
contribution will be paid in the form of cash and the amount need not be paid
to the Steering Committee. The Associations have to pay contribution for which
they have given consents in the meeting in the form of crossed cheque to the
Advocates directly as per the directions of the Steering Committee under
intimation to the Steering Committee.
The meeting has authorized
the Convener to contact all Associations which are in the mailing list of the
Steering Committee to obtain their consents in connection with payment of contribution.

Since courts are considering the request of the Government for extension of time period for submission of counter affidavit, the decision of the court is expected to be come after 1/1/2016. However, we are sure that 7th Pay Commission may consider replacement scale of Rs. 2400 Grade pay to LDC. The implementation of the upgraded pay scale to LDC w.e.f. 1/1/2006 is only possible after a positive decision from the court. I am sure there will be a positive decision on the matter

ReplyDeleteLDC UDC ka pay increase nehi hoga aur area bhi iss janam me kisi KO nehi melega. 100% guarantee. Stump paper me likh ke de sakta hu. Sab hi drama. Sref pay commission me aur sabhi ke sath kuch increase ho sakta he. So jao LDC UDC bhai log. Aur swapna dekh the raho. Kush raho.
ReplyDeleteDOPT is the nodal department for implementation of court order. But they always refuse to implement court judgement. Rather the avail "abscent" from court when the case come before the court for hearing. Later they declare that the court has not considered the issued on merit. By this tactics the elude from implementing the judgement to the similarly affected persons who are not enrolling themselves as a party in that case. This is nothing but draging every one to the court but for same cause. Their statement as follows:
ReplyDelete"As regards the Order dated 31.05.2011 in CA No. 1038/CH/2010 (Raj Pal vs UOI) of Hon’ble CAT, Chandigarh which was upheld by the High Court and Apex Court, it may be stated that the Apex Court has not considered the issue on merit. The said SLP was dismissed due to insufficient explanation to condone the delay in the filing of the SLP. As regards implementation of CAT Order dated 9.5.2012 in GA No. 141/2012, the administrative Department was advised for implementation for the petitioners only subject to outcome of Review Petition in view of Contempt case. It may also be stated that generally the judgments passed by Hon’ble Tribunals/Courts are applicable/implemented to the specific case, unless there is any direction for similar dispensation to be extended to similarly placed persons. Hence, the above Orders pronounced favoring the applicants by the Tribunal/Courts and implemented on attaining finality or due to contempt or due to any other reason may be taken as exceptions/aberration."
If they want the issue should be considered on merits by the court, then they appear before the Hon'ble court and conduct the case. They should bot abstain from appearing before the jduge and should not try to delay the case.
We should be very particular in getting positive judgement and implementation of the judgement to similarly affected persons by this anomaly in every department..
SLP (Civil) Case No.21803/2014 was to be listed on 16.12.2014. What is the outcome?

ReplyDeleteRajasthan government main be UDC ko 4200 wala grade pay milta hai to Govt. of India main kyo nahi ? aur ab to Rajasthan Government ne 5400 wale grade pay ko bada kar 6000 kar diya hai. Means Govt. of Rajasthan jyada liberal hai
ReplyDeleteLDC ka responsible office me sabse Jada hota he. Work bhi Jada he. Magar payment sabse kam. It is injustice and 100% injustice. Immediately individually sab LDC PM aur Finance minister KO letter lekho.
ReplyDeleteLDC ka pay increase nehi hoga to baki non gazetted post ka pay bhi immediately kam Karna hoga. It is our present demand.
ReplyDeleteI want to comment that I was appointed in ord. fys. in 1969 in the scale of Rs. 140-180 i.e. more than the scale of UDC. Retired as Jr. Works Manager w.e.f. 31.10.2008 in the grade pay of Rs. 4600/- (equivalent to Asstt. grade pay). Earlier Pay scale of Asstt. was Rs. 425-700 (now grade pay of Rs. 4600/-) to which I was promoted in 1980. It shows that I worked for 28 years i.e. from 1980-2008 without any incentive since I retired in the grade pay of Rs. 4600/-. It is what unions leaders have given to me and my collegues in Ordnance Factories. Union leaders enjjoy Govt. ptronage i.e. free accomadation, travel by air, enjoy taxi service from the departments to attend meetings with govt. officials. They become Minister later on. Only judiciary can help in resolving the grievances. Have any leader spoken about ordnance factory employees. Pay commission do nothing simply take feed back from seniors officers of the concerned departments. In our organisation senior officers talk about their own benefits. They look for merging the posts and how thier posts will be increased. They least bother about their subordinates. Though this blog, I would to make attention of 7CPC and Union and Association leaders, pl don't think only for urself. Further, I would like to mention that my junior, who was appointed to a lower post in the scale of Rs. 380-560 when I was working in the pay scale of Rs. 425-700 as a promotee and was always junior to me till the date of my retirement. Due to recommendations and policy of my department, he got the ACP w.e.f. 1.1.2006 in the pay scale starting from 15600-.... with grade pay of Rs. 5400/- and I am given pay scale starting from Rs. 9300/- Rs. 4600/- being a promotee. Later on I wrote to my deptt. to resolve the grievance since the DOPT issued some clarifications. My deptt has been reluctant to resolve the issue at its own and forced me to knock at the door of judiciary. There is no justice in this country.
