Sub: Redressal of the grievances of Ministerial Staff of DPD & SDRD –regarding.

Sir,

It is to bring to your kind notice that the DPD Hqrs Unit Committee of this Association had sought an appointment with the DDG (I/c, Admn.), DPD to discuss some long pending genuine grievances of our cadres which he orally turned down. The matter was discussed by the available members of Central Executive Committee at Kolkata and decided to go an indefinite pen down from 31.3.10. Accordingly a letter addressed to your office has been sent vide letter No. AIAMS(Gr.C)/DPD/Kol/09-10 dated 26.03.10. Subsequently, the Kolkata Unit had discussed the matter with the Association Hqrs and they were advised to postpone the pen down until this letter sends your office.

It is worth mentioning here that this Association had written several letters to DPD Hqrs, on the redressal of the genuine grievances of the Ministerial Staff of DPD & SDRD, since the SIU. But no action has been taken to solve the same as the issues raised are still stand good. Thus instead of inviting the delegation of the Association to discuss the burning issues of the Ministerial Staff, the DDG (I/c, Admn) DPD flatly refused to meet them. Our Association is recognized one under the JCM scheme, which stands for amicable settlement of the issues through bilateral discussions. But it is regretted that the stand adopted by the DDG (I/c Admn) is against the very principle of the JCM scheme.

It is further bring to you that the recommendation of the 6th Pay Commission has severely disturbed the vertical relativity in the pay scales of the LDC, UDC, Office Superintendents and AAO of the Ministerial Cadres. This distressed the Ministerial Staff a lot and without the active support of the Administration this anomalous situation can not be removed. When the officer concerned is refusing to hear us, how these genuine grievance could be redressed.

It is therefore requested that please look into the demands put forth by our DPD Unit personally for a favorable action at the earliest.

LETTER TO THE HON'BLE PRIME MINISTER

Sub: Upgradation of grade pay of LDC & UDC in the Administrative branch of Government of India Offices.

Respected Sir,

With due respect it is to bring to your kind notice that the Sixth Pay Commission has not recommended vertical relativity in the pay scale/grade pay of the LDC & UDC of the Administrative offices compared to their lower cadres. The Government while implementing the report has ignored this aspect which ultimately caused to put these dynamic young cadres in great distress. When the matter was taken up with the higher office of our Ministry we have been told that LDC and UDC are common cadres in the Government of India Offices and therefore any change in the pay scale at this level in a particular department alone is not possible.

Lower Division Clerks in the Central Government Office are appointed through Staff Selection Commission by conducting highly competitive examination. The minimum required academic qualification for the post is now is 12th Standard. Majority of the persons selected for the post are graduates and even post graduates and qualified to handle any kind of assignment including computer.

As per DoPT Manual the work allotment for the post of LDC in the Government of India Offices are maintenance of inward-outward registers, copying, preparation of arrear statement, typing of letters, filing etc and accordingly the pay scale for the post has been decided by the successive pay commissions. Since practically the work allotted/done by them-qualitatively and quantitatively- are many fold higher than the prescribed allotment, the pay scale granted to them on the lines of DoPT manual was not sufficient and as such several of the major Department viz. Income Tax, Central Excise, etc. has upgraded these posts to the pre-revised scale of 4000-6000/4500-7000 in the nomenclatures to suit the concerned Department through restructuring etc.

Moreover, the job profile of the post of LDC has undergone significant changes after introduction of modernization in Government offices. Now, computers have taken the place of typewriters. As a result LDC & UDC have been trained to work in various computer applications viz. Word Processor, M.S. Excel etc without granting the minimum pay scale prescribed for doing work in computers. Moreover, they are also engaged in day-to-day work using the various software viz. pay bill software, income tax software, uploading of details of officials covered under New Pension Scheme etc.
The offices of the Ministry of Statistics, especially its field offices are functioning smoothly virtually due to the fact that LDCs & UDCs are shouldering heavy responsibilities. Here LDCs have been allotted major section. Similar is the position of other subordinate offices especially the smaller offices and even then the Pay Commission has not considered adequate pay for the work done by them. This has affected desperately to the enthusiasm of this young and talented cadre in the Government offices.

These facts were well aware to the Government while implementing 6th Pay Commission report/MACP and yet any action to improve the grade pay of the LDC & UDC has not taken. Mean while the pay scale/grade pay of the erstwhile group D has been increased many fold by granting 3 ACP by ignoring the promotions/ACP granted to them in the pre-revised pay scale which awarded them double benefit. As a result they got a very upper hand over the pay structure of the LDC/UDC. Similarly, the posts holding the pre-revised pay scale 5000 have been granted 3 fresh ACP under MACP by ignoring promotions and ACP given in the past. While welcoming this decision, we are compelled to put up the demand to increase the grade pay of the LDC/UDC on the following reasons:

1. Lower Division Clerks in the Central Government Office have been appointed through Staff Selection Commission by conducting highly competitive examination.

2. Major Departments have upgraded the post by granting 4000-6000/4500-7000 pre-revised pay scale through cadre restructuring.

3. The pay band of Group D, LDC & UDC are same. The status of one particular post in the Sixth Pay Commission is considered by grade pay. The grade pay of LDC is Rs. 1900/ whereas a group D getting MACP will be placed in a grade pay of Rs. 2400/. This is highly demoralizing.

4. In the subordinate offices viz NSSO, LDCs have been allotted major sections/work viz. Establishment, Accounts, Budget, Income Tax, Store etc., worth to do by Assistant and Office Superintendents(grade pay 4200) with the responsibility of noting & drafting of the respective seats. (Please see work allotment to the LDCs by some Regional Offices of NSSO in Annexure I to IV). Moreover, several of the Ministerial Cadres in the offices of Government of India especially in the smaller offices are lying vacant, the duties and responsibilities of the such posts has to be forcibly shares by the staff on roll in public interest which ultimately falls on the shoulders of LDCs/UDCs.

5. The LDC/ UDC in the Central Government offices especially in the smaller office are highly trained to handle computers, the offices who got trained them to handle the computers have not bothered to recommend the upgradation of their scale/grade pay at-least to the minimum of the EDP staff. The working of the EDP staff and LDC are different. The EDP has only to enter the data given to them into a specific programme where as the LDC has to create data/letters in connection with sections allotted to them and type(including typing it by creating minor programmes in the MS Excel etc) it in various software applications.

6. A comparative study of the duties and pay scale granted to group D and LDC during 5th & 6th Pay Commissions are given below:

This is evident that the position of LDC& UDC in the Government of India Offices has gone down in the Sixth Pay Commission. A group D(now group C with out work assignment) official with comparatively less qualification and work norms is getting more benefit than an LDC, in comparison to the 5th Pay Commission pay scales, who is basically responsible for the smooth running of the offices.

During the 5th Pay Commission, pay scale S-1 to S-4 were granted to the group D posts and pay scale S-5 was granted to LDC i.e. one step above than the Group D posts. In the 6th Pay Commission the pay band of group D, LDC & UDC are same and Grade pay of LDC is 1900/ and that of group D through MACP is 2400/. Thus the pre-revised pay scale of LDC & UDC may be merged for granting Rs. 2800/ grade pay, which is the immediate higher grade pay of Rs. 2400/ granted as 3rd ACP to erstwhile group D staff.In order to remove this anomalous situation it is our fervent appeal that kindly issue necessary instructions to revive the grade pay of the LDC & UDC of the Government of India Offices.

Recognition under new Constitution

Sub: Defining categories of employees for the purpose of CCS (Recognition of Service Association) Rules.

Madam,

This is in reference to your letter No. B-12011/4/2009-Ad. III dated 12.3.10 on the above subject. In this connection it is re-iterated that Confederation of Central Government Employees & Workers, in which I have been elected as National Organizing Secretary, had submitted a demand to Government of India to include all categories of staff that come under Pay Bands I & II for recognition of Association under JCM Scheme and the same is under consideration of the Government.

It is also bring to your kind notice that the non Gazetted Group B staff have been allowed to function under JCM Scheme by the Government of India. Accordingly we had sent a letter dated 4/1/10 to the Ministry seeking a clarification whether the Ministerial posts in NSSO Offices with grade pay of Rs. 4200 are gazetted or not. It was also requested to supply a copy of the DoPT order No. 11012/7/2008-Estt- A dated 9.4.2000. But we have not received any reply so far.

Considering the fact that the Non-Gazetted Group B have already been allowed to function under JCM Scheme, this Association has decided to function as the Association of the Group C & Group B Non Gazetted Staff and accordingly necessary amendments have been made in the Constitution and put up for kind approval please.

CONSTITUTION

Article I (a) Name:

The name of the Association shall be “All India Association of Ministerial Staff (Non Gazetted), Ministry of Statistics & Programme Implementation, and Government of India.

(b) Head Quarters:

The Head quarters of the Association shall be the place of posting of the General Secretary.

Article II Aims and objectives:

(a) To render efficient service to the Department and through it to the nation.
(b) To safeguard and promote the interests, rights and privileges of the members, through constitutional means.
(c) To promote unity and foster fraternity amongst the members.
(d) To promote social educational and economic upliftment of the members.
(e) To consider and suggest improvement in their working conditions and conditions of services, pay and allowances etc.
(f) To collaborate with all Service Associations on all matters effecting the interest of the Government employees.
(g) To do all such other things as are incidental and conducive to the attainment of the above subject.

Article III Constituent Units:

(i) The Association shall consist of all Ministerial staff with Grade Pay ranging from Rs.1800 to 4200 of the FOD, DPD, and SDRD and IS Wings of NSSO, Ministry of Statistics & Programme Implementation.
(ii) Head-quarters Offices of DPD, SDRD, FOD and IS Wing and Zonal/Regional Offices of FOD and D.P. Centers of DPD.

Article IV Membership:

All Ministerial Staff with Grade Pay ranging from Rs.1800 to 4200 working in FOD, DPD, SDRD and IS Wings of NSSO, Government of India shall be eligible for membership.

Article V Admission:

(a) Membership shall be granted on application in the manner provided for
in Annexure ‘A’.
(b) Any official of the aforesaid category desiring to become the member of the Association shall make an application to the General Secretary in the prescribed form (Annexure ‘A’) through the unit Secretary with a non refundable admission fee of Rs. 20/ (Rupees twenty only) which will be collected directly by the Association.

(c) Each member shall pay a yearly subscription of Rs. 240/ (Rupees Two hundred forty only) which would be deducted from the pay roll of the employee on yearly basis after an undertaking is given to that effect in annexure ‘B’.

(d) The power to admit a member to the Association shall be vested with the General Secretary.

(e) Any member, in case of non-submission of his yearly individual consent in annexure ‘B’ will cease to be a member of the Association.

(f) The member who loses his membership for non-submission of yearly individual consent or by resignation of his own accord can be restored membership by the General Secretary on payment of the arrears (except monthly subscriptions which will be deducted from the pay roll of the employees) and re-admission fee Rs. 20/ on the recommendation of the Unit Secretary, which will be collected directly by the Association.

Article VI Funds:

(a) The funds of the Association consist exclusively of subscription from members and grants, if any, made by the Government and are applied only for the furtherance of the objects of the Service Associations.

(b) Special contribution from members which will be collected directly and kept by the Association in a separate fund.

(c) The Central Treasurer will collect membership subscription from the Government.

Article VII Management:

The affairs of the Association shall be managed by the following bodies:

(i) Unit Secretary at Unit level only.
(ii) (a) General Secretary at National Level;
(b) To supervise the working of units and representing them at
different levels as and when required.


Article VIII (a) Unit Committee:

Each Unit committee shall be represented by the following office bearers:

(i) Unit Secretary
(ii) Treasurer
(iii) Executive Members: 2 Nos.

(b) The members of the Unit shall elect the Unit Committee for a period of two years in the Unit meeting which will be held once in two years.

(c) Each Unit shall sponsor one delegate if the staff strength of the Unit is 5 or less than five for the purpose of participation in the Biennial Conference of the Association. The Unit having a sanctioned strength of more than 5 shall sponsor two delegates only. The Head quarters unit of FOD, DPD, SDRD & I.S. Wing each, shall however sponsor 5 delegates. The office bearers viz President, Vice President, General Secretary, Joint Secretary and Treasurer will attend the Central Committee Meeting in their capacity as delegates.

Article IX Central Committee:

The Central Committee shall consist of the members sent by the Unit Committee and the office bearers of the Central Executive Committee and shall be known as Central Committee. The Central Committee meeting known as Biennial Conference shall elect the following office bearers which will be known as Central Executive Committee (CEC).

1. President (One)
2. Vice President (One)
3. General Secretary (One)
4. Joint Secretary (One)
5. Treasurer (One)
6. Executive Members (Eight)

7. The Departmental/Office Council members shall be nominated by the Central Executive Committee.

8. The Vacancies caused by death, resignation, transfer or promotion to group B (Gazetted) etc. in the CEC shall be filled up by co-option by the Central Executive Committee and the members so co-opted shall function till the unexpired term of the concerned elected office bearers.

Article X Duties and powers of Central Committee known as Biennial
Conference:

It shall be the Supreme Legislative body of the Association and shall have absolute control over the office and properties of the Association. It shall have the following powers and functions to perform.

(a) To elect office bearers.
(b) To consider and adopt the Report and account.
(c) To adopt the budget estimates of the Association.
(d) To effect amendment in the Constitution of the Association (This would require ¾ the majority votes of the members present and voting). The amendments of the constitution/byelaw of the Association however shall be made only with the approval of the Government as per the term of Rule 6 (g) of the recognition rules.
(e) To discuss and decide all question of common interest of the members of the Association and policy of the Government/Department affecting them.
(f) To appoint ad-hoc committee for a specific purpose.

Article XI Election:

(a) Election to the Central Executive Committee (President (one), Vice President (one), General Secretary (one), Joint Secretary (one), Treasurer (one), Executive Members (8) shall be by majority voting by the members present.
(b) The election will be conducted by a sub-committee appointed by the General Secretary by secret ballot in case majority members willing to do so.
(c) Elections for various posts of office bearer of Unit Committee as given in Article VIII (a) shall be held in the Unit Committee meeting once in two years by a majority voting by the members present.

Article XII Notices of the meeting:

Notices of the meeting of the Biennial Conference shall be served at least 30 days before the actual date of meeting. In case of emergency a meeting can be convened at a short notice.

Article XIII Quorum:

The quorum for the Central Committee Meeting (Biennial Conference) shall be 25% of the total members of the Central Committee.

Article XIV Meeting:

The Central Committee shall meet at least once in two years. The meeting shall be convened by the General Secretary, in consultation with the president. The President shall have the power either to convene the Central Committee Meeting himself or to authorize a responsible member from the Central Executive Committee in writing, to convene the Central Committee Meeting, if the General Secretary fails to call the meeting before the expiry of the term of the committee as provided in Article XVIII (i).

Article XV Expenses of the Central Executive Committee:

Fifty percent of the realization (subscription etc.) of the units and the grant of the Government will be the fund at the disposal of the Central Executive Committee. The Central Executive Committee will bear:

(i) All expense of the Central Committee Meeting.
(ii) The boarding and lodging expenses of the delegates during Central Committee meeting/Central Executive Committee Meeting if the funds at that particular time permits.

Article XVI Venue of the Meeting:

The Venue of the meeting shall be selected by the General Secretary. In case the President convenes the meeting as per provision in the Article XIV he will decide the venue.

Article XVII Reception Committee:

General Secretary/President (person whom calls the meeting) shall nominate a Reception Committee which shall make all arrangements for the meeting.

Article XVIII Duration of Office:

(i) The CEC and office bearers of the Unit Committee shall ordinarily held office for two years. However, if the elections are not held within three months after the expiry of two years term, the office bearers would cease to be duly elected representatives of the Association.

(ii) Vacancies caused during the term of the office bearers of the Central Executive Committee shall be filled up for the unexpired term of the office bearers as provide in Article IX (8).

(iii) No resolution of the confidence/censure against any or all members of the Central Executive Committee shall be taken up at any meeting unless 30 days prior written notice signed by at least 12 delegates of the last General Body Meeting has been given to the General Secretary.
Article XIX Function of office bearers:

President:
The President shall preside over all the meeting of the Central Executive Committee Meeting and Central Committee meetings. He will have a casting vote in case of a tie.

Vice President:

The vice President shall exercise all the powers of the President in his absence. He shall assist President in his work.

General Secretary:

(a) The General Secretary shall be the Chief Executive of the Association and administer the day to day affairs of the Association.
(b) He shall be responsible for all the correspondence of the association.
(c) He shall keep all the records of the Association in his custody except the records relating to accounts.
(d) He shall convene all meetings of the Central Executive Committee and Central Committee, subject to the provision given in article XIV.
(e) He shall place a report of the working of the Central Executive Committee before the Central Committee meeting.
(f) He shall be responsible for furnishing an up-to-date copy of the rules and audited statement of accounts of the service Association and list of members and the list containing names of office bearers of CEC to the Government as when requires.
(g) He, as Chief Executive of the Association will have powers to meet any emergency that may arise during the tenure.

Joint Secretary:

(a) The Joint Secretary will perform all the functioning of the General Secretary in his absence except power at (g) above.
(b) He shall also assist the General Secretary in his work.

Treasurer:

(a) The treasurer shall maintain funds and accounts of the Association.
(b) He shall be personally responsible for the safe custody of the funds and records pertaining to accounts matters of the Association.
(c) He shall prepare the statement of Income and Expenditure of the Central Executive Committee and place it before the Central Committee.
(d) He shall have an imprest of Rs. 1000/ for day to day expenditure.
Article XX Sanction of expenditure:

General Secretary shall be authorized to incure expenditure up to Rs. 10000/ at a time, to be ratified by the Central Executive Committee. For the expenditure of an amount in excess of Rs. 10000/ prior approval of the Central Executive Committee shall be necessary.

Article XXI Financial Year:

The financial year of the Association shall be 1st April to 31st March.

Article XXII Audit of Account:

(a) The Accounts of the Association shall be audited biannually by an auditor appointed by the Central Executive Committee before its submission to the Central Committee.
(b) The Auditor shall be from General members of the Association other than the members of the Central Executive Committee.

Article XXIII General Supervision:

The Central Executive Committee through the General Secretary shall be authorized to look after the General and Financial Administration of the Association and that of the Units. General Secretary shall conduct meeting by circulating letters amongst the members of Central Executive Committee to take decision on important matters to be ratified in the next CEC Meeting, in the intervening period of two CEC meetings.

Article XXIV Unit Committee:

(a) The name of the Unit Committee will be ….. Regional/Zonal/D.P. Centre/Hqrs of FOD/DPD/SDRD/IS Wing Unit of all India Association of Ministerial Staff Ministry of Statistics and Programme Implementation, Government of India.
(b) The Head quarters of the Unit shall be the Head quarters of the Regional/Zonal/DP Centre/Hqrs of FOD/DPD/SDRD & IS Wing.
(c) The affairs of the unit shall be managed by the Committee as per Article VIII.
(d) The jurisdiction of the unit shall be as limited to the office which the represent.
(e) The other power and functions of the committee shall be similar to those of Central Executive Committee which shall be limited to the unit committee only.
