MACP ON PROMOTIONAL HIERARCHY

Representation to DoPT

Dear friends,

National Anomaly Committee had identified that the grade pay hierarchy implemented in the MACP scheme in comparison to the previous ACP scheme created anomaly. But the Government of India had not rectified the anomaly despite of repeated requests by the staff Side and as such the affected person/ Associations had to approach the court for justice. Hon’ble Supreme Court of India in its judgment dated 05.03.2020 in M.V. Mohanan Nair Vs Union of India and connected cases had accepted that there is anomaly in MACP scheme in certain pay scales and the DoPT has been directed to rectify the same.


Since the DoPT had not made any serious efforts to rectify the anomaly of MACP scheme in view of the findings of the National Anomaly Committee, employees/Associations had to approach the court. Thus any positive and immediate action from DoPT cannot be expected.  In order to expedite action at DoPT level, affected Associations/Individuals can write to the DoPT. We, in consultation with our lawyers, have drafted a letter in this connection which is given below. All affected Association/Individuals may be sent their representation to DoPT. Necessary correction in the letter can be made according the nature/cadre of the Association.

REQUEST FOR SETTLEMENT OF ANOMALIES IN MACP SCHEME
AS DIRECTED BY HON’BLE SUPREME COURT OF INDIA

Respected Sir,

1.         This representation is submitted as per the observation made by the Hon’ble Supreme Court of India in the judgment dated 05.03.2020 in M.V. Mohanan Nair Vs Union of India (C.A No. 2016 of 2020) and connected cases, that the Union of India and DOP&T to consider the anomalies in implementation of the Modified Assured Career Progression Scheme (MACP Scheme), which are noted in the said judgment and to take decision in accordance with law.

2.         Since introduction of Modified Assured Career Progression Scheme for the central government employees vide your HQ letter No.35034/3/2008-Estt (D) dated 19 May 2009, this association alongwith other associations have been strenuously demanding for the rectification of anomalies therein.

3.         Though the govt has constituted a committee to resolve the anomalies, no efficacious decision was taken by the anomaly committee, despite the fact that the committee was convinced about the anomalies. Hence certain employees and staff associations have approached various high courts all over India and got favourable judgments stating that the MACP to be granted in the promotional hierarchy instead of hierarchy of grade pays envisaged in the MACP scheme.

4.         Union of India has challenged these judgments of high courts by filing SLP (C) No. 21803 of 2014 and other connected SLPs. During deliberations, the apex court has admitted that there are anomalies in MACP scheme. However, the court relegated the matter to Union of India and DOP&T to resolve the anomalies. Copy of judgment in SLP (C) No. 21803 of 2014 is enclosed herewith for your kind perusal please.

5.         MACP scheme is less advantageous to the employees as compared to ACP scheme. Following illustrations will reveal the vast variation between the ACP beneficiaries and MACP beneficiaries:-

6.         The following chart shows certain hierarchical grade pays recommended by the 6th CPC and implemented by the govt:-

             As seen from the above, an employee recruited with grade pay of Rs.2800/- is getting a hike of Rs.1400/- on 1stupgradation under MACP scheme. Whereas, another employee with more qualification and appointed in a much higher post with grade pay of Rs.4200/- will be getting a hike of Rs.400/- only in 1stupgradation and only Rs.1200/- in all the three upgradations together. (Refer table in Para 5 (A) above in respect of JE). It can also be seen from Para 5 (A) above that a JE is getting a hike of Rs.400/- in 1stupgradation, but when the JE is experienced more, the hike in pay will be halved to Rs.200/- in 2ndupgradation. Moreover, it can be seen that there is no steady increase in hierarchical grade pays.                                                                                                                                  
7.         It could be seen from the above that MACP scheme is highly detrimental to most of the employees. It may be specifically noted that financial upgradation given at each stage is less than an yearly increment, which not at all compensates the agony of acute stagnation prevailing in the central service. Most of the employees are either retiring without earning even a single promotion or with only one promotion at the fag end of their service. The wide variation at each stage in ACP and MACP schemes may be noted specifically.

8.         The comparative study made above axiomatically prove that the 6th CPC, though said to be an expert body, has not applied proper mind while modifying the ACP scheme, ipso facto, the MACP scheme became totally unscientific and highly detrimental to the employees. Owing to these wide variations in benefits, MACP scheme discriminates employees with reference to those who have got benefits under earlier ACP scheme and still serving together. This disparity is totally against the equality enshrined in the Articles 14 & 16 of the Constitution of India. Employees governed by MACP scheme are highly demoralised, which ultimately adversely affects the efficacious functioning of govt machinery. Hence it is inevitable to follow a uniform scheme for all the employees.

9.         In view of the facts enunciated above, it is earnestly requested to wipe out the anomalies in the MACP scheme. As the employees are succumbed to this oppression for more than a decade, an early favourable decision in the matter is solicited please.

2.         Since introduction of Modified Assured Career Progression Scheme for the central government employees vide your HQ letter No.35034/3/2008-Estt (D) dated 19 May 2009, the central govt employees have been strenuously demanding for the rectification of anomalies therein.

3.         Though the govt has constituted a committee to resolve the anomalies, no efficacious decision was taken by the anomaly committee, despite the fact that the committee was convinced about the anomalies. Hence certain employees and staff associations have approached various high courts all over India and got favourable judgments stating that the MACP to be granted in the promotional hierarchy instead of hierarchy of grade pays envisaged in the MACP scheme.

4.         Union of India has challenged these judgments of high courts by filing SLP (C) No. 21803 of 2014 and other connected SLPs. During deliberations, the apex court has admitted that there are anomalies in MACP scheme. However, the court relegated the matter to Union of India and DOP&T to resolve the anomalies. Copy of judgment in SLP (C) No. 21803 of 2014 being voluminous containing 46 pages, is not enclosed herewith, which may kindly be perused from the web portal of Hon’ble Supreme Court of India.


5.         MACP scheme is less advantageous to the employees as compared to ACP scheme. Following illustrations will reveal the vast variation between the ACP beneficiaries and MACP beneficiaries:-

If all Group C employees submit their represesntations to the DOPT (either directly or Through Proper Channel) to grant MACP on promotional hierarchy, we can achieve our ultimate aim of implementation of Modified ACP Scheme on Promotional Hierarchy w.e.f. 01.01.2006. Let us all achieve this target together and win the battle of Justice. Only we can help outselves as all the Group A Officers are trying to deny this Justice to Group C employees at any cost.

  4. Dear Leaders,
    Do you think this endless process will bring the fruitful result or agitate the government to look into the suffering employees of the Central Government?
    This exercise have been done through the years or the day of suffering started that is why many employee went to court after exhausting the channel and got favourable judgement based on natural justice at up-to high court level but Hon'ble Supreme Court prolonged this case for years and started the note/judgement without using the jurisprudence (nothing is said that which clause of the constitution debars the rights of suffering employees where as it essential to safe guard the rights of its citizen on the scale of equality and welfare) and took care of government's plea that it will cost expenditure on exchequer not the humiliation or sufferings of the employees. The proposed exercise could be done but ultimately will turn futile, we all know because government has already shown its colour and mind set as reflected in the different Minutes of the Meetings held between JCM & DoPT etc. and various appeal to FM & PM by different Associations.
    My humble suggestion is Please file the Review Petition immediately OR /and ask for a Larger Bench to judge it on the scale of mandate of Indian Constitution, law of the land, doctrine of welfare , equal pay for equal work, junior cant take higher salary etc. Though our Lawyers did their best but engage ‘practical advocates’ known for their skill to get justice.

    2. Well said. Never did the Supreme Court countered the argument that the MACP scheme cannot be worse than the ACP scheme it is replacing. Pay commissions are supposed to safeguard the interests of employees across the spectrum.

  5. Yes Mr.Sanjib, I fully agree with you. Mere submission/sending of representations to DoPT may not bring the results. We should also seek/explore possibilities for a Review the decision of the Supreme Court Bench by approaching a Higher Bench for JUSTICE through experienced Advocates. It is the duty & responsibility of the Apex Court to consider the mass requests of the Low paid Group C employees and to protect their interests.

  7. UDC 01.12.1995 GRADE PAY RS.2400/-, MACP LAST & FINAL 01.9.2008 GRADE PAY OF RS. 2800/-. I HAVE ALSO COMPLETED 10 YEARS OF SERVICE SAME MACP AS A UDC WITH SAME GRADE PAY I.E; RS.2800. TILL DATE OF SUPERANNUATION ON 31.01.2019 WITH SAME GRADE PAY i.e;RS.2800/- WITH SAME POST i.e;.UDC.

The date of implementation of the Modified Assured Career Progression Scheme itself is a big anomaly as the date of implementation of the Basic Pay under the 6th Central Pay Commission is 1.1.2006, but MACP Scheme was implemented w.e.f. 1.9.2008. As a result, some of the staff got their financial upgradations under ACP Scheme as per promotional hierarchy upto 31.8.2008 and the remaining staff got their financial upgradations under MACPS w.e.f. 1.9.2008 by merely placing them to the next higher Grade Pay/Level. The Modified ACP Scheme has taken away all the charms of the ACP Scheme and defeated the purpose of granting ACP. The word "Modified" has lost its value, as it is less advantageous to the staff, which is nothing but downgrading the morale of the staff. Many Courts have come up with the conclusion that the MACP Scheme was irrational and the employees should get their financial upgradations as per promotional hierarchy.

All the continuous & strenuous efforts for the last 5-6 years made by the employees & Association for granting of MACP on Promotional hierarchy have gone waste with the Apex Court Verdict and subsequent issuance of DOPT order No. 22034/4/2020-Estt.(D), Dated 23rd March, 2020. The Association may kindly make efforts to approach the next immediate authority or to approach a Higher Level Bench of the Supreme Court.

  20. It is very demoralising for person getting promotion from pb 2 5400 to pb3 5400.
    If any one look at the matrix of 7th cpc in these 2 grade pay. Pb2 5400 gets more increment and higher salary fixation than Pb3 5400. Kindly have a look.

  28. Nurses in Central Govt. r now being appointed in GP4600(PB-2). How come they have been granted 3rd MACP in GP 6600/- (and not in GP 5400/-(PB-3) , as is being granted to others appointed in GP4600) by DOPT. Seems arguments were not rationally put forward.

    1. It is because our Supervisory Senior Officers does not want LDC/UDCs to get a handsome pay based on our contribution in Accounts/Establishment/Administration matters. They want to take all credits and want a handsome Pay for them. We LDC/UDCs are always treated like a 4th Grade People (now even MTS are getting a handsome pay without any responsibilities). Association should struggle hard to get a favourable decision for the poor LDC/UDCs

I wonder why the Associations of Central Government Employees has not tried any progress in the case and has given up the case without filing a Review Petition in a Higher Bench of Supreme Court of India to get Justice in favour of employees. The MACP Scheme should be on Promotional Hierarchy Only. The word Modified means a modification in favour of the Employees. The Only Modification in the MACP Scheme, compared to old ACP Scheme should be that in Place of 2 Financial Upgradations on 12/24 Years, it should be 3 Financial Upgradations on 10/20/30 Years. The Financial upgradation on next level is a mistake made by the Committee and it should definitely be on Promotional Hierarchy only. This matter should be brought to the notice of the Supreme Court of India, then only we will get Justice from the Apex Court.

  35. We are waiting for the grade pay upgradation for LDC and UDC, kindly work on this very seriously. Now the difference in LDC and MTS is only 100 Rs and having no responsibility. While LDC has to work on file as well as also enter all records in computer. He is working on everyone file but no one is working for him. He suffers financially. Kindly work on this

  39. Shri TKR Pillai please update grade pay uprgradation case of LDC and UDC. You were the flag bearer of the case in 2013 still no update. You have misguided innocent LDCs.

Also dont subscribe to them. In 2012-13 Pillai fooled new LDC UDC saying they will get 2400/- grade pay but I knew he was fooling these naive candidates. LDC UDC DONT HAVE ANY FUTURE HERE.

Sixth Pay Commission has denied and appropriate pay structure not provided to the LDCs & UDCs serving in offices of Govt of India in the light of raised academic and technical qualification & responsibilities assigned to them. Clerks are responsible for smooth functioning of offices but they are given simple replacement GPs in VI pay commission. In fact the GP granted to the post of LDC is Rs.1900, which is just Rs. 100 More than MTS staff, i.e Rs. 1800/- The pay commission has recommended the merger of various GP ‘D’ posts & upgraded their GPs from Rs. 1400/- to Rs. 1800/- & also given them additional benefit of 3 MACPs to the merged posts. On the other hand LDC under MACP would get Rs.2000/- Rs.2400/-, & Rs.2800/-

    Over the years, the scales of pay of various posts below the ministerial post at the lowest rank (Viz. LDC) as well as posts at higher levels have been upgraded from time to time. However, the scale of pay of the post of LDC has not been revised since 01.07.1959 while minimum educational qualification for the post of LDCs has been increased to 10+2 from Matriculation. The job profile of LDCs has undergone significant changes after introduction of Information Technologies and modernization in Govt Offices. In the wake of Govt’s plan of office automation, e-tendering, e-procurement and e-governance. the workload & strain on LDC has already grown up but inspite of above the Grade Pay of LDCs is only Rs.100/- more than, that of MTS Staff.

  69. HOW THE SUBSEQUENT PAY COMMISSIONS HAVE
    DEPRIVED LDCs & UDCs OF VARIOUS MINISTRIES OF THEIR
    LEGITIMATE RIGHTS
    INTRODUCTION:
    For a number of years now, especially after the 6th CPC, the problems
    faced by LDCs and UDCs have started gaining prominence. The unity and
    sense of purpose among them makes them look all set for the kind of victory
    that Pharmacists had. Common sense of purpose, unity and dedication sure
    make success possible!
    HISTORY:
    In order to decrease the number of grades, the 6th Pay Commission
    combined all the different grades between Grade Pay 1300 to Grade Pay
    1800 into a single grade – Grade Pay 1800, thereby wiping out the entire
    Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those
    who lacked the minimum education levels, illiterates and everybody else
    were lumped into Group ‘C’. Their Grade Pay was also raised to Rs.
    1800. But, at the same time, employees working as LDCs, who have a
    minimum educational qualification of Class XII and also possess some
    technical education / computer applications skilss, were not given any
    upgrading. Instead, they now had to share their grade with lesser-qualified
    former Grade ‘D’ employees.
    The next huge trouble originated from the MACP. Those who didn’t get
    any promotion for years are given career upgradations through MACP. LDCs
    who didn’t get any promotions for more than 10 years were given their next
    grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere
    Rs. 100 turned out to be a huge disappointment to many.
    JUSTIFICATION:-
    In the modern era of digitization and a technologically savvy world
    where computers replaced typing machines, every department / Ministries
    require LDCs be well acquainted with the sound knowledge of computer
    applications and internet. Though the entry qualification for LDCs is
    Intermediate but in the absence of Assistant/UDC (due to shortage of staff
    across all ministries), he is handling additional voluminous job of
    Assistant/UDC such as preparation of Pension papers, Pay bills, submission
    of Disposition lists and other routine work in the hour of need and is always
    made to attend higher nature of jobs in the Departments and ministries.
    COMPARISON OF LDC AND DEO:-
    In accordance with the recommendation of 6th Pay Commission,
    Government of India has raised the academic qualification from Matriculation
    to 12th class pass or equivalent and technical qualification of typing from
    manual typewriter to sophisticated computer for getting selected to the post
    of LDC through Staff Selection Commission. It is to be noted that typing on
    computer is far different from the typing on typewriter because for typing on
    computer one should have the sound knowledge of the operation of
    computer or which one required to undergo a computer training program.
    The academic qualification required for both LDC & DEO are the same
    i.e., 12th class pass or equivalent. As regards the technical qualification. Moreover, the DEO has
    only to enter the readymade data given to them, whereas the LDCs have to
    create data/draft letters and then type it on computer, putting up the matter
    through file note with justification with the support of rules and procedures.

    REALIZATION OF ANOMALY BY STATE GOVERMENTS
    Various state governments have taken cognizance of the monumental
    mistake of the 6th CPC & the anomaly caused thereof and have
    immediately taken corrective measures to impart justice and uphold dignity
    to the deprived LDC & UDC of the state governments.
    Following states have upgraded the grade pay of LDC & UDC:
    PUNJAB
    KERALA
    RAJASTHAN
    HIMICHAL PRADESH
    CONCLUSION:-
    This is a clear case of anomaly for which 6th Pay Commission is to be
    held responsible. However, even the 7th Pay Commission did not pay heed to
    representations and requests by various associations and confederations.
    The merit of the case demands:-
    UPGRADATION OF GRADE PAY OF LDC TO Rs. 2400/-
    UPGRADATION OF GRADE PAY OF UDC TO Rs. 4200/-
    The issue is required to be raised at NATIONAL JCM LEVEL and
    the government be apprised to accept the legitimate demand

  71. Clerical staff LDC UDC ko barso se sarkar ne, adhikari ne aur Associations ne bas bewakoof hi banaya hai. Issme koi nayi baat nahi hai. Bura toh tab lagta hai jab hamari association subscription leke hamare hith ka mudda kabhi nahi uthate. Na kabhi association ne LDC UDC grade pay ka mudda JCM k saame rakha aur na hi JCM ne kabhi is mudde ko sarkar ke Saamne uthaya. Gramin daak sevak se leke dusre department ke industrial staff ka mudda bhi JCM me hota hai par LDC UDC ki koi baat nahi karta kyu ki kisi ko padi nahi hai.

Sir, by going through this website on first visit i was very much excited and hopeful and was visiting continuously from last five years, but ultimately i found that the matter of upgrading Pay of LDC/ UDC is kept pending sinnce before compilation of Seventh pay comission. So this all is really seems that its an brilliant attempt to make fool to all the person who so ever is hopeful.

    Till date is there is any progress or any mile stone achieved till date in case of LDCs/ UDCs and it will never be achieved, because the secretary or who so ever is called to be dealing official is not a self victim. So for him him its just a entertainment or a mock trail. Sorry but a cruel fact.

  92. Is the Steering Committee update about the real movement of the case or they just kept it in Dustbin ? If efforts are on please let all of us know 1. Have the Committee or Aggrieved party moved the Apex Court for Review of the judgment ? 2. Have the Committee or Aggrieved party moved the Apex Court with request to constitute a Larger Bench to review the said ill judgement ? 3. What are the other progress like the Meeting of JCM etc ? Please post it on this platform for transparent understanding failing which it will be presumed that the leaders are no more a leader in this case and their palm are greased.

  93. The LDC and UDC case has listed to hearing on 01-04-2020 and adjourned with directions. The association still not informed or posted on this web what was the action taken in this regard. OK. sir. but one year has been completed, what happened in this case or any directions full filled though affidavit to CAT. pl post on this site. If not taken any further step. pl. inform that you are not taking any interest in this case. So, we may understand that association or steering committee has not interested in this case and also in MACP case of H'ble Supreme Court to file review petition on ill judgement.

    Hope you all are safe during this ongoing pandemic. You have to be safe because you all have to make us FOOL. Again you have to come for çhanda' assistance so that you all may bargain with government management so that your wards get benefit, job, contacts etc.
    None of you have updated about THE ACTION initiated after MACP decision by the Apex Court. Have we challenged it for revision or approaching for higher bench ? Please introspect, if you all have sold out your soul and morale than you know that what the judicious staff believed in your leadership have been saying......I don't want to mention it is written on the wall prominent and loud.
    You have a CHANCE TO BRIEF THE MEMBERS of association and other organisations because believing Steering Committee we all extended our contribution, good wishes.

    First assessment as attendant 950-1500 wef 1.4.1991
    Open selection from 25.10.2000 as LDC 950-1500 same pay scale as attendant
    Second assessment from 1.11.2011 as senior assistant after 20 year in the same scale.
    Retired wef 30.11.2019 after completed more than 36 years of service in IIT Kanpur. But only award tel assessment.
