It seems like a positive developement in DOPT as they are expecting that the supreme court judgement will favor "MACP in promotional hierarchy" which has beenpronounced in favor of our staff side, in all lower courts. The secretary, who took unfavorable, anti employee and harrasment decisions so far, now relinquise the responsibility to accept the cour decision to a joint secretary.

  2. When a lower give judgement in favor of staff, the appointing authority can implement the judgement. But they refer the judgement to DOPT and thus avoid the implementation of judgement, which termed as contempt of court by lower courts. Now, the DOPT said that, "The matter has been considered in this Department and it has been decided that the recommendations of the Screening Committee henceforth be placed before the Appointing Authority of the post in both cases where the Committee is constituted in the Ministry/Department or in other
    cases for approval with regard to grant of financial upgradation under MACP Scheme", which means that the secretary level is not need and screening commitee etc, are enough to honour the court judgement.
