ReplyDeleteThis case deserves to be heard and decide favourably. Hon'ble supreme court be requested to took decision in the larger intrest of govt employees who are eagerly waiting for it since long. Association is losing faith due to lingering the case.

Pillai sir, please inform the case diary number of LDC case at Jabalpur CAT and other relevant CAT case diary number in relation to other associations, if available. DOPT telling through RTI reply that LDC issue is not under listed anomaly and never that was before. In this context, please clarify us.

MACP case SLP(C)21803/2014 UOI vs. Mohanan Nair listed for date 22-09-2017. There after no listing is seen for the past 3 months. What is happening? (delay is happening) On behalf of affected employees we request that the lawyers appearing on behalf of staff side may please be contacted and reason for delay may please be revealed.

ReplyDeleteThe status of case is not known since last three months. Website of Supreme Court also does not specify progress of the case after listing of case in Sep 2017. As a citizen of India,we may approach Public Relation Officer of Hon'ble Supreme Court under Right to Information Act with request to furnish next date of hearing/reasons for non inclusion of instant case in Cause List.

ReplyDeleteSomething terribly fishy is happening in SC. Even senior judges have lost faith in incumbent CJI. Main Culprit here is BJP govt at the centre who is perusing this case in SC so far. This case originated because former SC Judge BN Srikrishna foolishly inserted the word 'grade' in the MACP rule. This has created huge problem for many Central government employees while implementing MACP.

DeleteThis is quite injustice to fix a cutup dt. 31.8.2008. There would have been option of acceptance of MACP (10,20,30 )or ACP ( 12, 24) on departmental promotional hierarchy suitable to the emplyee.

ReplyDeleteWill Supreme Court decide MACP case on 13.3.2018. Shame on Modi Govt and his Law Minister to contest MACP case in SC. Central government employees are getting about 10 lacs as retrial dues after working for 30-35 years in govt and the former FM with his son took millions of dollars as bribe when in office. PM is still trying hard to nail the culprit. PM is going after poor and honest govt employees by filing SLP in SC to stop the legitimate dues of govt employees. Even if SC decides in employees favour, PM will sit on the order and will not issue notification for disbursement of long pending employees dues. Talk and action of PM is inconsistent in employees welfare issues in other matters also. That's why I am saying all this.
ReplyDeleteIs someone is in touch with Adv Sudhir Naagar and Adv O.P. Bhadani Advocate for staff in MACP case in Supreme Court. Case is listed today 13.3.2018 tentatively. Atleast secretary of this forum should get in touch with advocates for speedy disposal of this case. Intervener applications are filed in MACP cases which is delaying the final outcome according to me.Only Adv on record can confirm this and take remedial measures.

ReplyDeleteAny update on MACP case in Supreme Court. Now SC sits for hearing in the midnight too, to decide cases, but still does not find time to decide long pending SLP 23333 of 2014 of Central Govt employees issue. As such incumbent BJP govt has no consideration for central govt employees plea.

ReplyDeleteGovt Employees in the Level upto 9 especially non- gazetted ones are highly in justified in respect of promotional as well as MACP benefits. Supreme officials at the HAG Level being the policy makers and their executors, have always been the best recipients of promotional/ financial/ CPC benefits. where all other employees were given multiplication factor of 2.57 in VII CPC, these gentlemen enjoyed the direct multiplication factor of 3 leaving all others in shock. The same tradition was practiced in VI CPC also.
Secondly, NFU benefits have been provided to the Grade- I officers above Level- 10 after completion of 5 years service in the promotional grade. Now see the disheartening and humiliating plight of non- gazetted staff. No timely promotion. Introduction of MACP has become a root f pain and sorrow for the affected employees. After completion of 10 years of service they are thrown in the next hierarchical grade pay. They are not considered eligible for promotional benefits even after 10 years. Is this their fault? An employee in Level 7 with no promotion in 20 years who is eligible for Level- 10 on promotion is ruthlessly fixed in Level- 08. Two Levels down!!! This not only deprives him of 7200 TPT per month but also eligibility of higher entitlements leaving him frustrated and screaming.
This is simply because our policy makers have feudal mindset that they avail all benefits themselves and scatter the Juthan to the lower employees. These high office holding stalwarts have been noticed saying that, "Keep your subordinates busy and troubled in some or the pay related problems. So that they are busy solving them. If you dont do so they will consider themselves equal to you in rank and you will have no importance in office."
Now our able leaders are in office for 5 years and are surrounded by these sycophant high officials where they see their high salary and promotional benefits and think that everywhere in offices the atmosphere is the same. ALL EMPLOYEES ARE DOING NOTHING, ONLY ENJOYING!!!!
Please come out of this self obsession attitude and think differently.

ReplyDeleteOn 30.7.2018 this case was fixed for hearing by SC order dated 2/5/2018. Can someone through light on the next date of hearing in MACP case in SC.
ReplyDeleteCongress sat on this issue since 1/1/2006 and now BJp govt is bulldozing central government employees by still persuing this case. Certain section of employess are denied their legitimate expectations by incumbent BJP government.

For this, the person, his mobile number and bank account number may be given on this website so that persons interested in this case may contact and deposit voluntary contribution to fight for the big cause. I request to take up this case seriously by the ALL INDIA ASSOCIATION OF ADMINISTRATIVE STAFF and start a new strategy.

ReplyDeleteWhy association of Central Govt. Employees don't write or give feed back of the MACP case, they may ask for contribution to employee who are suffering due to MACP scheme i.e. next promotional grade should be granted to them instead of next grade. For example, as a LDC we had joined the department in 1993 and we have been promoted in 2016, so, ASO grade pay 4600 or Level 7 granted in 2016, if we win the said case, our basic pay will be fixed 17140 in the year 2013, hence, benefit of 3 increment will be granted to all our colleague. It is very big jump for all of us. Therefore, we all are curious to know the status of this case.

ReplyDeleteYes case is listed for hearing today i.e. 28.08.2019 in the regular bench in the (Supreme court of India)of Hon'ble Mr Justice Rohinton Fali Nariman, Hon'ble Mr. Justice R. Subhash Reddy & Hon'ble Mr. Justice Surya Kan, CL No.104. I wish, the decision should be come expeditiously in favour of employees.As case is going on in regular bench of 3 Hon'ble Judges of Supreme Court, there would be no excuse for government to linger on this decision. I had joined the service as a LDC in 1993, if court grant MACP on promotional basis, ASO/Grade-II DASS grade pay 4600 should be granted to me in the year 2013. But this grade pay has been granted me on 01.01.2017 after promoted from UDC to ASO. Therefore, if this decision comes in employees favour i.e. MACP on promotional basis, my basic pay in grade pay 4600 or Level 7, will be fixed 21.6.2013 after completing 20 years of service. Benifits of 3 increment will be received to me. I have given my example only for the purpose of to calculate all my colleagues who are also suffering like me. Presently my basic pay is Rs.49,000/- if court decide case in our favour, my basic pay will be fixed today Rs.53600/-. Hence, we are waiting for this case anxiously. There are lots of my colleagues in ministries, autonomous bodies, state government and so on , all will be benefited if MACP grant us on promotional basis instead of next grade pay. ReplyDeleteI think, Hon'ble Supreme Court will deliver their judgment at the earliest as case is going on since 2014 and they have to assess the case of merit base because Kerala High Court has already given decision in favour of Govt. employees i.e. MACP should be granted on behalf of promotion basis instead of grade pay. ReplyDeleteDate of final hearing in this case is 17/10/2019. Therefore, we may expect to Hon'ble Supreme Court to give their historical judgement. I hope, judgement should be in favour of the employees i.e. MACP should be granted on promotional basis instead of next grade pay. 4600 Grade pay of ASO will be granted to all of our colleagues after completing 20 years service who had joined their duty as a LDC.Sanjiv

ReplyDeleteDate of next hearing is 15/01/2019. surely decision will come in our favour and all of our colleagues would get good amount of arrear and it would be difficult for the government to release the arrears because MACP on promotional basis will be applicable to all of those employees even working or pensioners who are effected wef. 01/09/2008. Supreme court should not linger on their decision regarding this case. We should hope, decision may be come maximum 3-4 months. Regards sanjiv.

ReplyDeleteArguments have been completed and the case is now reserved for orders. We expect a judgment allowing MACP on promotional hierarchy. Hope for the best for all colleagues, judgment should be come in our favour. Advocate C K Sasi (AOR), who was well briefed by Association, argued for M V Mohanan Nair, Advocates, representing to other respondents also done commendable job. Actually it was a well organised team work. Amicus Curiae presented the case extremely well. He also submitted a written statement of his arguments to the court. Now, Decision may be come out 2-3 days. Regards Sanjiv
