MACP on Promotional Hierarchy – Written reply in Parliament

The employees including Group ‘C’ (which includes erstwhile Group ‘D’) are granted three financial upgradations under Modified Assured Career Progression (MACP) Scheme in the next immediate Grade Pay hierarchy as per CCS(Revised Pay) Rules, 2008 on completion of 10, 20 and 30 years of regular service.

There have been instances where Tribunals and High Courts have directed to grant benefits under Modified Assured Career Progression (MACP) Scheme in the promotional hierarchy. However, in such cases, the order of Court is specific to the applicant only.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Kamlesh Paswan in the Lok Sabha today.

  1. The second para states that CAT and H.C. have directed to grant MACP benefits under promotional hierarchy, but the order of court is specific to the applicant of that case only. But, please clarify that, in Supreme Court SLPs, what will be the government's stand and will the apex court give a common order to grant MACP under promotional hierarchy which will be beneficial for all employees with out knocking the door of courts. Also,It is our request to T.K.R.Pillaijee, on behalf of every employees working all over India, that, our associations must request the apex court through our advocates appearing in SLPs, for a common order which will grant MACP benefits on promotional hierarchy to all eligible employee.   2. If that be the case, all affected employees will knock the door of courts which will be flooded with cases. Hence, I request our beloved T.K.R. Pillai to voice our case strongly to Supreme Court so that time and money can save.

  3. Shri Pillai ji, It is evident from the statement of the Minister that MACP have been granted to the applicants of court cases. This fact is to be brought to the notice of the Hon'ble Supreme Court.

  5. Pillai sir, kindly explain what Govt. is saying, to my undrstasnding if this will happen then all affected person will approach court to get benefit, its a ridiculous. KINDLY INFORM US WHETHER THE SLP WILL HAVE A COMMON DECISIONFOR ALL OR SPECIFIC.

  6. We need to include in the SLP verdict that when there is a policy error it can't be restricted to fews moreover how these poor employees could face such huge expanses of court.

  8. Only Apex Court has to give its verdict positively covering all the affected persons. Lets pray God and hope best on 04.01.2016 (let it be our New Year Gift)

  9. "..... specific to the applicant only" - what does it mean? All the affected Govt employees have to become busy in filing court cases only for their legitimate benefits. This is not a rational idea of Govt.

  10. Judgement of appex courts are equally applicable to all employees where as high courts n CAT judgements are for individual cases if I am not wrong.

  11. This shows apathy towards govt employees by Govt. If judgment of apex court is in favour of the employees, it should be applicable. Hon'ble SC may be requested to apply the judgment on similarly situated employees irrespective of employees gone to court or not.

Instead of adopting a cheating and deceptive attitude towards lower grade employees which is evident from the fact that the after the grade pay 5400 there is no difference in promotional and hierachical pay and driving the lower cadres to the doors of justice govrnment should act atleast now in a proper manner. when such action is not in sight we should strive to get a common judicial order applicable to all employees.

  12. Supreme Court seems to play hide and seek game with the affected employees by adjourning the case for long time and hopes are rising in the same way. Hope tomorrow may deliver the judgement in favour of employees.
