Grant of MACP on hierarchical basis-hearing postponed to 16th May 2014

filed by the Government, against the principal CAT order for granting MACP on
hierarchical basis to 19 UDCs of Defense Department, scheduled to be held on 16/04/2014,
has again been postponed to 16th May 2014.

DeleteWhy the DOPT are more interested to file appeal against grant of MACP scheme in promotional hierarchy grade pay. The DOPT should amend the orders of MACP scheme in terms of verdict of Supreme Court of India vide SLP (CC) No.7467/2013 dated 15-04-2013. The delay created by the DOPT shows that they are purposely not willing to grant legitimate dues of LDC/UDC. But whoever is involved in this conspiracy to deprive of benefits to LDC/UDC, they all will go to hell. God is great.

ReplyDeleteRespected Pillai sir copy of court case filled in Jabalpur CAT for upgradation of Grade pay of LDC has not publish in this website so far, sir it iwill be publish or not?
ReplyDeleteOur Advocate advised us to not publish the case filed in the web site because the case is under consideration of the Court. However, copy of the same has been sent to some selected Associations who are willing to file similar case in other courts through e-mail. Now the court has issued notice to the respondents.

First I thanks to Sri.Pillai Sir and team for upgrading this matter on your site. I would like to inform you that the H'ble CAT, Principal Bench New Delhi already held in OA NO. 864/2014 w.r.t to the CAT, High Court and Supreme Court Judgement that
ReplyDelete" In our considered view , once an order has been passed by this Tribunal and it has also been upheld at the level of the Supreme Court , there is no question of waiting for an approval from any Government Department for implementation of the same. The respondents, therefore, should have considered the representation of the applicants on Merits ".
Hence, I request you to kindly give the publicity that all the LDC/UDC's who are effected in the MACP may should approach their department through the representation quoting he above Judgement.
Kindly prepare the standard format of application and publish the same in your Site for better utilisation of the same. It will help to brig all LDC/UDC's in one shelter and same track. Thank you Sir and your team and I am waiting your reply in this matter.
Respected Pillai Sir, in the case of Union of India versus Rajpal, the Hon'ble Supreme Court dismissed the SLP CC No.7467/2013. Judgment date is 15-04-2013. The order says,"There is no sufficient explanation given to condone the delay". The delay has been done by the Government. Again, in this 19 UDC of Defence Department case, the Govt. side practicing the same delaying tactics. We, it is our request sir, through our association, put a check to make this delaying tactics come to an end. The Natural justice is "delayed justice is denied justice" . Thanking you for your relentless efforts in support of LDCs and UDCs welfare.
ReplyDeleteThe High Court of Punjab & Haryana,Chandigarh is having a different view on the subjectin the cases of various C.A.T. employees whereas High Court of Delhi is having altogether different view because Delhi High Court has stayed the operation of Judgment delivered by C.A.T.,Principal Bench,New Delhi in the case of Sanjay Kumar and others of Defence department. During the pendency of Writ petition in Delhi High Court the Supreme Court may or may not interfere in the matter. In my view, the matter is required to be referred to a Full Bench having atleast five Judges so that controversy ends and employees all over the country are given due benefits of M.A.C.P.Scheme
