MACP on Promotional
Hierarchy- Final hearing on 17/10/2019.
At present around 45 cases against
SLP filed by the Government are attached with the main case of MV Mohanan Nair
Vs Union of India. Several of these cases are not directly related to the
subject MACP on promotional hierarchy. Thus, according to information, on 25/09/2019, the bench headed by
Justice Bhanumati directed the solicitor General to classify the cases subject
wise and submit notes on behalf of Government by 14th October. Similarly,
the bench asked all respondents to submit brief synopsis on the case filed by
them by 14th October.
Further, the court categorically
stated that the final hearing of the case will be done on 17th
October and there will be no further extension. Advocate C K Shashi and Sr
Advocate Giri will submit the synopsis in connection with the case of MV
Mohanan Nair.
Thus we have to wait till 17th
October to know the result of MACP case. I think there may be a positive result
in the case.

ReplyDeleteIf the decision of the court is in favour of the employees, then the court should direct the DOPT to issue amended MACP orders so that everyone don't have to run to the court to get justice.
ReplyDeleteYeah. You are right, Sir. Since DOPT is one of the petitioners in the case, they must be order accordingly by the Apex Court to avoid undue delay in passing of the benefits to several aggrieved govt. servants.
DeleteWhat exactly happened on 17th October? Did the case come up for hearing or not? Why the final hearing of the SLP has been postponed to 26/11/2019? Please throw some light on this. Thank you.
