Giving membership to the 'Group C' Staff & submission of individual Consents-Regarding.

Dear members,

As has already informed that letters (regarding the recognition status of the Association and membership to the Assistants), sent to the Regions by the FOD are not based on the facts. Our Association is still recognized one. Further, our request for the inclusion of the Assistant as members of the Association is under consideration of the Ministry. You are aware that all Ministries except Ministry of Statistics of the Government had accepted all Non-Gazetted Staff in their Department as members of the Association working under JCM Scheme. Income Tax Inspectors with 4600/ grade pay are members of the Association recognized under JCM Scheme. Thus denial of membership for the Assistants with 4200 grade pay is not justified.

Meanwhile, the Association of the erstwhile group D in the name of All India Association Group C Staff (not recognized so far) has been trying to fetch Ministerial Staff to their fold. Despite of all efforts they have no succeeded in their mission so far. This is due to the reason that the Ministerial Staff know our Association through relentless struggles achieved several things for the betterment of the service conditions, promotion etc of the Ministerial Staff so far. In the year 1993 when our Association is formed Ministerial Staff were retiring on the post of UDC. Now the situation is improved. Retirement of every Ministerial Staff on 5400/ grade pay is our aim and we work accordingly.

At present we are at work with three important issues. (1) Merger of the Posts of Office Superintendent & AO and granting of Rs. 4800 grade pay. (2) Upgradation of the grade pay of Assistant to Rs. 4600/. (3) Merger and upgradation of the posts of LDC and UDC and granting of Rs. 2800/ grade pay. You have already seen the efforts made by us to achieve the aforesaid demands so far from our letters etc. All the correspondence made in this respect can be seen in our web site.

Since the erstwhile group D has been brought under group C folder by the CPC, there is a chance to accept our demand for a single Association for all Non Gazetted cadres by the Ministry. Thus we want to bring all erstwhile group D staff (now group C) to our fold to strengthwen the Association & keeping it in the first position. Further, from our past experience, I am sure that we can handle the issues of the group C (erstwhile group D) effectively so that they may get a better service condition and promotion channel in the days to come.

Thus all unit Secretaries/members of the Association are requested to please obtain the individual consents of the Group C staff in annexure B and forward the same, duly certified by the Unit Secretary, to the HO immediately. A copy of the Individual Consents alongwith Annexure A may please be forwarded to this Association Hqrs. Since I am on long leave following an accident, the letters may please be sent in my Residential Address i.e. 74/11, Govind Apartment, Govind Garden, Govindpura, Bhopal-462023.

This may be treated as most urgent.

  4. It is very good proposal over all, but it needs some modification. The Grade pay of the LDCs should be Rs.2800/- and of the UDCs should be Rs.4200/- and any merger required, there should be the merger of UDCs & Assistants. The logic behind this is that the minimum educational qualification for UDCs and Assistants is same (i.e. Graduation), both comes through the same examination and almost nature of duty is the same, difference is only the cadre. There should not be discrimination on the basis of Cadre.
    It is pertinent to mention here that earlier minimum service required for promotion from UDC to Assistant was 5 years. After DoP&T OM issued in 1998 the mimimum regular service for promotion from UDC to Assistant was enhanced from 5 to 10 years. Now the in many Department Grade Pay of Assistant is 4600, hence according to ibid OM the minimum service required for promotion from UDC (GP-2400) to Assistant (GP 4600) will be 15 years. It is the death blow for this Cadre.

    It is the true case for violation of fundamental rights and against the principle of equality.

    Particularly in all the Offices LDCs & UDCs are paying their contribution immensely in comparison to any other Cadre. They are doing all types of work and multi-functional work in different organizations. In these circumstances how it can be justified that UDCs/LDCs pay more contribution to the organization but receive less pay and perks in comparison to other Cadre. Doesn’t differ from the soul of the welfare of our national conception and constitution of India itself where the principle of ‘equal pay for equal work’ has been adopted? Why the Clerical Cadre is being discriminated all the times? Why the contribution of LDCs/UDCs have been forgotten all the time ? Doesn’t differ from the soul of the welfare of our national conception and constitution of India itself where the principle of equal pay for equal work has been adopted ? Isn’t it against the natural law of justice?

    3. The principle of “Equal pay for equal work” should be applied in case of UDC also. Some important judgment of Hon’ble Supreme Court on the principle of “equal Pay for equal work” is RANDHIR SINGH V. UNION OF INDIA & ORS., AIR 1982 SC 879; STATE OF HARYANA & ORS v. RAJPAL SHARMA AND OTHERS, AIR 1996 SC;
    The principle of equal pay for equal work has been confirmed many a time by the Hon’ble Supreme Court and it is adopted by the Central Govt. and State Government in many of the cases too. Why, this principle is not applicable to UDCs (Clerical Cadre). Why this Cadre will always be deprived of granting Fundamental Rights provided under Article 14 (Equality before law) and Article 16 (Equality of opportunity in the matter of public employment – (1) There Shall be equality of opportunity for all citizen in matters relating to employment or appointment to any office under the State). The apex Court has held that the word ‘employment or appointment’ were wide enough to include tenure, duration, emoluments and duties and obligations, whether the employment is temporary or permanent. They cover amongst themselves not merely the initial appointment, but also salary, increments revision of pay, promotion, gratuity, leave, pension etc. ( Champak Lal v. Union of India, AIR 1964 SC 1854; Shiv Charan v. State of Mysore, AIR 1965 SC 280 (282); Union of India v. Kashikar, AIR 1986 SC 431. We should represent this submissions to the respective Governments through Associations.

  5. Your effort is very good for the LDC & UDCs but please consider the LDC & UDC of the Sub-office cadre also for the same benefit. You may well aware that the most of the Sub offices are being in operation with either 1 LDC & 1 UDC or only either 1 LDC or 1 UDC. There is a proverb that "from stitching chappal to enchanting Chandi mantra" LDC or UDC of the suboffices are the lone staff to do all kinds of jobs of administrative, accounts, stores etc. etc. So, the LDCs & UDCs of Sub-offices must be considered for getting the same benefit as is being trying by you. My whole hearted support is with you.

I appreciate all the comments given by all my Central Govt. friends & colligues .I also want to add only 1 line that in case of Store-Keeper also there is no difference of Grade-Pay between a Labour and Storekeeper posts.The grade pay of Store-Keeper should be increased or an extra alowance should be given to them. Store-Keepers while working together with Labourers or peons feels guilty and many times hear " Tu mere se bada hai kya , tere aur mere grade-pay mein kya farak hain " and other insults also.

  7. Firstly thanks for best efforts for merger of LDC & UDC with G.P. 2800/-. Here we brought into your kind notice that in income tax in 2001 there was merger of posts through restructuring of cadres, a newly post Tax Assistant g.p.2400/- was created after merger of LDC, UDC & DEO'A' and recruitment rules shows eligibility condition i) graduation (ii) 8000 key depression speed on computers through SSC. Despite having additional technical qualification, the Tax Assistant getting less scale of pay since 2001 now grade pay 2400/-

Here we want to brought into your notice that in Income Tax 'Notice Server' who have prescribed minimum education qualification 8th standard has been awarded grade pay of Rs.2000/- as per sixth CPC. Whereas LDC having minimum education qualification 12th standard are getting only 1900/- grade pay. What a mockery 6th CPC ?

    Please also take note of considering the Data Entry Operator's Cadre.

    There are 4 different stages but less promotional aspects.

    01. DEO Gr. A - Grade Pay 2400/-
    02. DEO Gr. B - Grade Pay 2800/-
    03. DEO Gr. C - Grade Pay 4200/-
    04. DEO Gr. D - Grade Pay 4800/-

    Please raise this matter also with the government.

    We are fighting for this but till no progress we get.

  10. 6th CPC as well as MACP is really made a Joke of LDCs. Status of every cadre has been upgraded whereas LDCs cadre have been downgraded in 6th CPC and further in MACP as if they are unwanted in the system. This reminds me the famous proverb "MY SALARY MAKES ME FEEL SMALLER".

  11. HI TO ALL I AM NAGARAJ, LDC, MIN OF DEFENCE, 1ST OF ALL THANKS TO ALL THE MEMBERS WHO ARE TRYING FOR THE MERGER OF LDC/UDC WITH GRADE PAY OF RS2900/-. WHAT EVER MY SENIOR AND CO STAFF OF ALL DEPARTMENT TOLD ABOUT OUR CADRE IS 100% RIGHT WE ARE THE LESS BENEFICIARIES IN 6TH PAY COMMISSION. I FEEL VERY GUILTY TO SAY THAT MY SALARY IS EQUAL TO PEON OR MAZDOOR. BEFORE THE PAY COMMISSION MY OFFICE PEON IS DRAWING RS.500 LESS TO MY SALARY BUT NOW HE IS DRAWING RS. 500 MORE TO MY SALARY. WE ALL MUST UNITE AND WE MUST FIGHT FOR OUR REASONABLE BENEFICIARIES. THANKQ FOR THIS OPPORTUNITY TO EXPRESS

  12. LDCs and UDCs have always been left out from any pay upgradations. Assistants, their hierarchical seniors have got upgradations thrice since 1990. Eventhough you claim that you are trying hard for the demands/pay upgradation of LDC and UDC as well nothing has come out so far and no expectation in view of no action in this line from DOP&T. How these Group 'C' cadre can depend on your assurance and your association?

  15. Presently, Group D employees are getting Grade Pay of Rs. 1800/- and LDCs are getting Grade Pay of Rs. 1900/-. So, Grade pay of LDC should be increased.

  17. Nothing will happen in this regard, LDC & UDC will continue to work as peon. LDC Grade pay-1900 after first ACP it will be 2000. i think leaders of employee union must think about it.

  18. recently educational qualification of LDC has increased, but still no upgradation of GP. emplyee who join on or after 01-01-2004 are facing much financial problems due to NEW PENSION SCHEME. still union is taking it lightly. no future of those employee who join on or after 01-04-2004. No gratuity, no pension even no security of their fund.

Recently educational qualification of LDC has increased from class Xth to XIIth, but still no upgradation of GP. Your proposal for merger of LDC & UDC is absolutely correct because almost all LDCs were working the job of UDCs. Please try always to get the goal.     1. I think as per that notification it is given as : LDC & DEO : 1900 & 2400. It means the grade pay of LDC is 1900 and grade pay of DEO is 2400. I don't how this difference is whereas the qualification for both it is Intermediat or equivalent only.

    as the Post of LDC is Up-graded??

DPOT had given benefits of 4200 hundred to CAO staff whereas the workload and responsibility of LDC or UDC of unit cadre is much higher the then the CA)/ministerial staff also to them promotion avenues are much more, in Indian Air Force an LDC becomes UDC after 12-15 years of service, ASST after 25-30 years of service . it is totally injustice with unit cadre staff as they were not given Rs. 4200 grade. It is also important to mention here that CADRE REVIEW HAS NOT BEEN DONE IN INDIAN AIR FORCE SINCE ITS INDUCTION .

    i was in the post of chief office supdt. in old scales rs.7450-11500 and the same has been place in 6th pc at g.p rs.4600 duly merging the office supdt.i.. a separe scale has to be given to ch os with gp rs.4800 as is done in fincance deptt. this may please be looked into
