NJCA MEETING HELD TODAY (30th JUNE) EVENING AT JCM NATIONAL COUNCIL STAFF SIDE OFFICE NEW DELHI, EXPRESSED ITS STRONG PROTEST AND DISSATISFACTION AGAINST THE UNILATERAL DECISION OF THE NDA GOVERNMENT ON 7th CPC RECOMMENDATIONS, REJECTING ALL THE GENUINE AND JUSTIFIED MODIFICATIONS SOUGHT FOR BY THE NJCA AND UNANIMOUSLY DECIDED TO GO ON INDEFINITE STRIKE FROM 6 A.M. ON 11TH JULY 2016.

Central govt staff disappointed, call for strike on July 11

NEW DELHI, JUNE 29:  
Expressing “serious disappointment” with the NDA government for not accepting modifications suggested by them, the National Joint Action Committee (NJAC), comprising 35 lakh Railway, Defence, Central government and Postal employees, has called for a strike on July 11.
“We have been pushed to the wall. The government has time till July 10 to reach a negotiated settlement with us,” Shiva Gopal Mishra, Convenor of NJAC, told reporters, seeking the Prime Minister’s intervention to quell “growing anger” among government employees.
Among other things, the NJAC is demanding higher minimum wages, restructuring of the National Pension Scheme, scrapping of the Bibek Debroy report on Railway restructuring, no FDI in Railways and Defence, regularisation of casual/contract workers. “Although there is justification of upward revision of minimum wage, the government has not done justice to the employees. Similarly, the multiplier factor has not adequately been revised,” said M Raghavaiah General Secretary, National Federation of Indian Railwaymen.
To decide the future course of action and prepare for the strike in “full swing”, the NJAC is slated to meet on June 30, M Krishnan, Secretary General, Confederation of Central Government Employees, announced. In a statement issued earlier this month after giving strike notices, the NJAC had said that it had been wanting “meaningful negotiation and settlement” of the issues. But, except hearing the leaders, the empowered Committee of Secretaries did not go further. “It acted as if it was powerless,” it said.

INDEFINITE STRIKE IS INEVITABLE
           With the cabinet accepting the 7th Pay Commission report without considering the genuine demands of the staff side, the indefinite strike called by the National Joint Council of Action(NJCA), commencing from 11/07/2016 will definitely going to take place. After the Cabinet decision today, Shri Shiva Gopal Misra, Convener, NJCA has appealed the Central Government employees to intensify the strike preparation. He asserted that Central Government will be responsible for the inconvenience of the people of India due to halt of train services from 11th onwards. He has said that the door of NJCA is still open if the Government is willing for a negotiated settlement. And an emergency meeting of the NJCA is taking place on 30/06/2016 to take stoke of the situation.
Central Government Employees was getting Rs. 15750 minimum pay on 1.1.2016 which was replaced with Rs. 18000 by the 7th Pay Commission i.e. a meager increase of Rs. 2250 which makes 14.29 percent. It is to be noted that the 3rdCPC gave a rise of 20.6, 4th 27.6, 5th 31.0 and 6th CPC 54%. It  was the meager increase of 14% provided for by the 2nd CPC that triggered the volatile situation in the civil service and led to all India strike encompassing all employees which lasted for 5 days in 1960. Staff Side has demanded Rs. 26000 minimum pay according to the Akykroyd formula. But the pay commission has taken the average of 12 monthly retail prices to arrive Rs. 18000/ which is not in accordance with Dr. Aykroyd formula for calculation of minimum pay.
It is worth mentioning here that 5th CPC recommended minimum pay on the rate of growth of economy for a period of 10 years. The per capita net product increase over the last 10 years of the country is 65.28%. If we apply this percentage for the calculation of emoluments as on 1.1.2016 the minimum wage as on 1.1.2016 for an MTS will be Rs. 26030. Moreover, the website maintained for the Agriculture Ministry depicts the retail prices of commodities which go into the basket of minimum wage computation.  If we calculate pay according to these figures the Minimum pay as on 1.1.2016 would have been Rs. 24850.  To convert the same as on 1.1.2016, 3% will be added as suggested by the 7th CPC.  The final computation will be Rs. 25,596, when rounded off shall be Rs. 26000.All these shows the demand of minimum pay Rs. 26000/ was genuine.

In the case of Bank, Insurance, many other Public Sector Undertakings and several State Governments wage revision takes place once in 5 years. Recently, Bank employees were provided more than 15% increase for next 5 years. The Andhra Pradesh State Government has implemented the recommendations of Pay Commission which provide Rs. 22600 minimum wage as on 1.7.2013. The corresponding figure of Rs. 22600 as on 1.1.2016 is 27000.
The Government while accepting the recommendation of 7th Pay Commission has given Rs. 1440  house rent allowance to an employee getting minimum pay  for  C class City. Can one dream to hire an accommodation for a family with a monthly rent of Rs. 1440; Never. In order to meet the additional burden of house rent, employees have to spare a part of their basic pay. When fact is like this why the Government is projecting the slight increase in HRA due to merging of DA to basic pay as an increase in the pay. It appears, all these are being done to create hatred in the minds of general people towards the Government employees. Government employees should beware of these publicity stunt and should prepare for the indefinite strike commencing from 11.07.2016.

Briefing the decision taken in the earlier meetings, the Convener of the Steering Committee has said that the Steering Committee had decided to intervene in the SLP filed against granting of MACP on promotional hierarchy by the Government against Shri M V Mohanan Nair (CAT Ernakulam) tagged with the cases of Shri Babu Ram, Smt Reeta Devi & Shri Dhirender Singh (CAT Chandigarh) and accordingly decided to raise funds to meet legal expenses of the case. But so far we have not initiated collection of funds in view of the fact that some affected Central Government Employees under the leadership of Shri Hari Lal of MES, Ernakulum has constituted a committee to raise funds to meet the expenses of the case and the funds so created has been spent for the legal expenses of the case so far. Now the funds so collected by them have been exhausted and as such they requested us to bear the expenses of the remaining hearings. Thus, the collection of funds for the remaining hearings has to be taken up by us and in order to decide the quantum of amount and mode of collection, this meeting has been convened, the convener said.
He further said that several of the Associations, who assured us to contribute funds for the purpose, have telephonically confirmed their willingness to contribute and asked us to give the bank account number in which the amount is to be deposited and as such the representatives of  that Associations is not participating in today’s meeting. As regards the payment of the amount to the Ernakulum committee, the convener has said that earlier we had decided that the payment shall be made to the advocate through crossed cheque, but it is not feasible to give dozens of cheques of smaller amount to an advocate and as such it will be more practical to transfer the amount to the bank account, exclusively opened for this purpose at Ernakulum and all Associations may be asked to deposit the amount in the said account.
Leaders representing various Associations/Unions present in the meeting expressed their willingness in favour of contributing amount from their Association funds, directly to the bank account, opened exclusively to operate the legal expenses of the case. Accordingly the meeting unanimously decided to request all Associations to deposit the amount directly to the above account.
The meeting asked the Convener to send the bank account to all Associations, who are willing to contribute, after obtaining it from the Ernakulum Committee. It was also decided to obtain a copy of the receipt of the amount deposited for the records of the Steering Committee.

1. Settle the issues raised by the NJCA on the recommendations of the 7 CPC sent  to Cabinet secretary vide letter dated 10th December 2015.
2. Remove the injustice done in the assignment of pay scales to technical/safety     categories etc., in Railways & Defence, different categories in other Central Govt. establishments by the 7 CPC.
3. Scrap the PFRDA Act and NPS and grant Pension/family Pension to all CG          employees under CCS (Pension) Rules, 1972 & Railways Pension Rules, 1993.
4.i) No Privatization/outsourcing /contractorisation of governmental functions.
(ii)Treat GDS as Civil Servants and extend proportional benefit on pension and  allowances to the GDS.
5. No FDI in Railways & Defence: No Corporatization of Defence Production Units and Postal Department.
6. Fill up all vacant posts in the government departments lift the ban on creation of posts; regularize the casual/contract workers.
7. Remove ceiling on compassionate ground appointments.
8. Extend the benefit of Bonus Act 1985 amendment on enhancement of payment  ceiling to the adhoc Bonus/PLB of Central Government employees with effect from the Financial year 2014-15.
9. Ensure five promotions in the service career of an employee.
10. Do not amend Labour Laws in the name of Labour Reforms which will take away the  existing benefits to the  workers.
11. Revive JCM functioning at all levels.

33 LAKHS CENTRAL GOVERNMENT EMPLOYEES WILL PARTICIPATE

A massive parliament march and rally of about 20000 Central Government Employees was held at Jantar Mantar, New Delhi on 24th June 2016. The rally was organized by National Joint Council of Action (NJCA) of Central Government Employees comprising Railways, Defence, Confederation and Postal organizations demanding modification in the recommendations of 7th Central Pay Commissions including minimum wage and fitment formula. Other demands are scrapping of New Contributory Pension Scheme, No FDI in Railways and Defence, Grant of Civil Servant status to Gramin Dak Sevaks, filling up of vacancies, enhancement of bonus ceiling, No outsourcing, downsizing, contractorisation and corporatisation etc.

The NJCA had already given strike notice to Government on 9th June 2016. The Modi Government is not ready for a negotiated settlement with the staff side. The rally called upon the entirely of Central Government employees to intensify the campaign and preparations and make the strike a total success.

The rally was presided by Shri. N. Raghavaiah (General Secretary, NFIR & Chairman NJCA), Coms. Shiv Gopal Mishra (General Secretary AIRF & Convenor NJCA), Sreekumar (Secretary General AIDEF) M. Sharma (NFIR) S. K. Tyagi (AIRF), Mrs. Champa and Mrs. Gita Pandey addressed the rally

About 33 lakhs Central Government Employees will participate in the strike. 40 lakhs Central Government Pensioners have declared their solidarity with the strike. Central Trade Unions had also extended their full support. State Government Employees Federations have cautioned the Central Government that they will also be compelled to join the strike if Government refuse to settle the demands relating to 7th CPC recommendations as majority of the state Governments are implementing the Central pay parity to their employees also.
