OBSERVE COM. S. K. VYAS JI REMEMBRANCE DAY ON 
13th FEBRUARY 2016

One year has passed since the demise of Com. S. K. Vyas Ji, the legendary leader of Central Government employees and Pensioners on 13th February 2015.

Com. Vyasji was the Secretary General of the Confederation of Central Government Employees & Workers for forty years from 1967 to 2006. He was the President and Secretary General of All India Audit & Accounts Association for a long time. He continued as an Advisor of the Confederation and also as the General Secretary of National Coordination Committee of Pensioners (NCCP) and Bharat Central Pensioners Confederation (BCPC) till death.

Com. Vyas Ji has lead various struggles and strike actions of the Central Government Employees and was in the forefront of the leadership which organised the first strike action of the Central Government Employees after Independence, in the year 1960. Com. Vyas was jailed and dismissed from service. He played an important role in rallying the Central Government employees alongwith the striking Railway employees in the year 1974. He was an able and uncompromising negotiator with the Government in the JCM National Council and standing committee. He was responsible for many of the benefits and allowances enjoyed by the Central Government employees. The cost indexation of wages was earned by the Government employees through the sustained struggles and efforts in 1960s under his leadership. The Confederation of Central Government Employees & workers representing 1.5 million civil servants was in the forefront of the incessant struggles and strike actions organised by the Indian working class against the neo-liberal economic policies of the Government. Com. Vyas Ji’s vision and ideological clarity has made the Confederation, part and parcel of the mainstream of the working class movement of India.

Com. Vyasji was the friend, Philosopher, guide and everything for the Central Government employees movement. In the more than six decades long trade union life, Com. Vyasji endeared himself to every section of the Central Government employees. His death has caused an irreparable and irreplaceable loss to all of us. He was a great leader, symbol of simplicity, a gem of a person and a leader who is down to earth. Extremely polite, kind hearted and compassionate. One of the finest human being, tallest leader, a gentle mentor and a legend.

He is in our hearts! His memories will be forever with us! His long saga of struggle for the cause of the employees and workers will inspire the generations to come.

The National Secretariat of the Confederation calls upon all the affiliated organizations, State/District C-O-Cs to observe 13th February 2016 as S. K. VYAS JI REMEMBRANCE DAY by holding meetings, Seminar etc. throughout the country.

Conduct three days Dharna at all state capitals


Conduct three days Dharna at all state capitals and Industrial Centres/Establishments on 19th, 20th & 21st January 2016.

NJCA head quarters decided to hold three days Mass Dharna at Jantar Mantar, New Delhi. Dharna shall commence at 10:30 AM and continue for full day on all three days.

There will be a huge rally of about 5000 Central Government employees (Railway, Defence, Confederation) at Jantar Mantar on 19th January during lunch hour. NJCA leaders will address the dharna and rally.

NJCA will meet on 8th February 2016 to decide the date of commencement of indefinite strike.

            The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its approval for setting up an Empowered Committee of Secretaries under the Chairmanship of Cabinet Secretary, in order to process the recommendations of 7th Central Pay Commission (CPC) in an overall perspective.

            The Empowered Committee of Secretaries will function as a Screening Committee to process the recommendations with regard to all relevant factors of the 7th CPC in an expeditious detailed and holistic fashion.

 REJECTION OF RETROGRADE RECOMMENDATIONS OF 7CPC AND NEGOTIATED SETTLEMENT OF 26 PONT DEMANDS INCLUDING THE FOLLOWING MAJOR ISSUES
·         Re-computation of minimum wage on the basis of the actual commodity prices as on 1.7.2015  and upgradation of LDCs as UDCs
·         Granting increment to 5 % and two increments as promotion benefit.
·         Fill up all vacant posts by holding spl. recruitment  drive
·         Increasing the number of MACP to five on completion of 8, 15, 21, 26 and 30th years of service.
·         Parity for all Stenographers, Asstts. Ministerial Staff in subordinate offices and in all the organized Accounts cadres with Central Sectt. by upgrading their pay scales (and not by downgrading the pay scales of the CSS)
·         Wage of Central Government Employees be revised in every 5 years
·         Treatment of GDS as Civil Servant and grant them all pay, allowances and benefits granted to regular employees
·         Regularize Contract/casual and daily rated workers  against the huge vacancies  
·         Introduce PLB in all departments. All existing bilateral agreement on PLB must continue to be in operation
·         Exclusion of Central Government employees from National Pension Scheme (NPS) and extension of defined benefit pension scheme to all
·         withdrawal of  ceiling on compassionate appointments
·         Continuation of allowances/advances in place of the recommendations made by the 7th CPC
·         The stipulation made by the 7th CPC to grant only 80% of salary for the second year of CCL be   rejected
·         50% of the CGEIS premium to be paid by the Government in respect of Group B and C employees.
·         Reject the recommendations concerning PRIS
·         restoration of the functions of JCM Scheme at all levels

Payment of Bonus (Amendment) Bill, 2015 notified: Increase in the Eligibility Limit under clause (13) of Section 2 and Calculation Ceiling under Section 12 of the Payment of Bonus Act, 2015:

        The Payment of Bonus (Amendment) Bill, 2015 was passed by the Parliament in the just concluded Winter Session of the Parliament. The Payment of Bonus (Amendment) Act, 2015 has been published in the Gazette of India, Extraordinary on 1st January, 2016 as Act No. 6 of 2016. The provisions of the Payment of Bonus (Amendment) Act, 2015 shall be deemed to have come into force on the 1st day of April, 2014.

          The Payment of Bonus (Amendment) Act, 2015 envisages enhancement of eligibility limit under section 2(13) from Rs.10,000/- per month to Rs.21,000/- per month and Calculation Ceiling under section 12 from Rs. 3500 to Rs.7000 or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher. The Payment of Bonus (Amendment) Act, 2015 also mandates previous publication of draft subordinate legislations, framed under the enabling provisions under the said Act, in the Official Gazette for inviting objections and suggestions before their final notification.

          The Government has been receiving representations from trade unions for removal of all ceilings under the Payment of Bonus Act, 1965. It is also one of the demands made by them during the country-wide General Strike held in February, 2013 and September, 2015. As the last revision in these two ceilings were made in the year 2007 and was made effective from the 1st April, 2006, it was decided by the Government to make appropriate amendments to the Payment of Bonus Act, 1965. 

          These changes in the Payment of Bonus Act, 1965 will benefit thousands of work force.
