MINUTES OF PUNE MEETING

Dear friends,

As you are aware that the meeting of the Central Executive Committee was convened at Pune on July 19 by issuing notice on 2/7/13(copy of the same was sent to the Ministry & FOD also). The minutes of the meeting were sent to the participants and Unit Secretaries through e-mail and so far no change/amendments are proposed by any of the participants. Meanwhile, some members participated in the meeting have informed their consent to finalize the minutes without any amendments. Thus a copy of the minutes of the Pune CEC is given hereunder for reading of the members/well-wishers. Please inform me opinion if any on the decision taken in the meeting for further action.

MINUTES OF THE CENTRAL EXECUTIVE MEETING HELD AT PUNE
ON 19TH JULY 2013

          A meeting of the Central executive Committee of the Association was convened at Pune on 19/07/2013 by issuing notice dated 02.07.13 and the meeting was organized by the Pune Unit of the Association at Central |Government Employees Colony, Pune. The meeting discussed the Problems faced by the Administrative Staff of Central Government in general and the demands of the Administrative staff of MoS & PI pending for disposal at various stages in special.

General Secretary’s report on the working of the Association after Mumbai GBM

Discussion/content
Decision/Action
The report touched each and every effort made by the Association to solve the common problems of the members during the last one and half years i.e. after the Mumbai General Body Meeting.  The report also explained the general situation of the working class in the country and the role of the Confederation to achieve the demands of the Central Government Employees.
Discussed in detail and adopted unanimously.

De-recognition of the Association by the Ministry.

Decision/Action
General Secretary has said that the reason given for de-recognition is not valid as far as the provisions of CCS (RSA) Rules are concerned. The reply for the last letter sent in the month of April 2013 is not received from the Ministry so far. However, in order to remove the present impasse the Association has to take a decision. Shri M Krishnan, newly elected SG Confederation has said that the action taken by the Department is not in accordance with the provisions of CCS (RSA) Rules 1993. He said the MOS&PI is the only Department in GOI has re-identified the distinct category which is against the spirit of the CCS *RSA) Rules 1993. Association has to chalk out action plan for status quo, he said.
The meeting discussed the matter in detail and decided to send letters appealing the Secretary, MoS&PI by all Units of the Association by October 2013. Also decided to convene the next GB in the month of December 2013.

12/12/12 Strike: Review and framing of our stand towards participation of strikes called by the Confederation in future.

General Secretary has informed that the Confederation of Central Government Employees & Workers, demanding 15 points charter including the demands for 7th Pay Commission, 50% DA merger w.e.f. 1.1.2011 & withdrawal of PFRDA Bill, had organized a March to Parliament Programme on 26th July 2012 in which 20000 Central Government Employees participated. Thereafter the call for organizing one day’s all India strike on 12/12/12 was organized in which around ten lakh Central Government employees participated. Recognizing the unprecedented success of these programs, the Railways & Defence Employees’ Federations have approached the Confederation with a joint action plan for getting accepted these demands. This compelled other Unions & some political leaders to demand constitution of 7th CPC.
Despite of a strike call given by our Association, none of our units except Bhopal & Patna have participated the Confederation called 12/12/12 strike. Our people succumbed with the fear psychosis spread by the Administration. GS appealed all Units to participate all programmes, including strike, called by the Confederation.
The meeting discussed the matter in detail. Members were of the opinion that,   since we achieve our common demands due to the relentless struggle and sacrifice of the Central Government Employees under the strong leadership of the Confederation, we should think & act positively towards the Confederation called programs including strike, in future.
     
4.
Merger of the posts of LDC & UDC and upgradation of Grade Pay

Decision/Action
GS has informed the meeting that our demand for the upgradation of Grade pay of LDC & UDC was not accepted by the Department on the ground that these are common cadres. Then the matter was put up in the National Executive Meeting of the Confederation by the GS in his capacity as National organizing Secretary of the Confederation. Thereafter, Confederation has put up the item to the National JCM as well as in National Anomaly Committee. In the mean time Association has sent a letter to the Prime Minister of India and the Prime Minister’s Office forwarded the same to the Secretary DoPT for further action. But the DoPT has not taken any action on the matter so far. Thus we obtained reply from the DoPT through RTI and sent a second letter to the Prime Minister citing the inaction of the DoPT on this genuine issue
Again, the matter was put up in the Kolkata Conference of the Confederation and a resolution was got passed.

The matter has been discussed in detail. The meeting appreciated the initiation taken by the Association for the betterment of the LDC & UDC. The meeting noted that our proposal become popular in various web sites and frequently discussing. The Railway, the defense Employees and all other Association have endorsed the demand. The discussions sum up with a note that the matter should be kept live till its implementation by the Government and the Association has to take the leading role in it.

Restructuring of the posts of Administrative Staff:

Initiating discussion, GS has said that initially the Ministry & the Internal Finance had accepted our proposal for the upgradation of grade pay of AO to 4800 but it appears, the FA advised the Ministry to resubmit the case with Rs. 4600 grade pay. Accordingly the Ministry changed the grade pay of AO to Rs. 4600 and resubmitted the case to FA and now the case is under consideration at Department of Expenditure. Meanwhile, Association appealed the ADG FOD to implement the restructuring of the Administrative Staff by December 2013 and the ADG has kindly assured us of the implementation of the proposal in the current year itself.
The meeting observed the inordinate delay in the finalization of the restructuring. Since the matter is in an advance stage an early finalization is expected. However, The Association should continuously pursue the matter till its finalization & implementation, the meeting decided.


6.
Upgradation of the Grade Pay of Administrative Officers in NSSO Offices

General Secretary has said that the Grade Pay of the AOs of the NSSO Offices especially the AOs of Regions is not at par with the duties and responsibilities assigned to the post. AO with similar duties and responsibilities in other GOI Offices has been granted Rs. 5400/ grade pay. The matter would be taken up after implementation of the current restructuring.
The meeting unanimously accepted the proposal and asked the Association to pursue the matter further.

7.
Creation of sufficient Official Language posts.

The GS has said that the Association was pursuing this case quite some time. As a result FOD has sent a proposal to the Ministry for creation of adequate number of Official Language posts which include Deputy Director & Assistant Directors OL and Senior Translators for various offices of FOD. The case was under consideration of the IFD of the Ministry.  DPD Administration is also requested to send proposal related to the Official Language staff at their Division.

The meeting discussed and arrived in the conclusion that the action is going on the right direction. And decided to pursue the matter.


8.
Granting of MACP on hierarchical basis

Decision/Action
The matter, at first, was raised by this Association. The MACP Anomaly Committee at National level was constituted following our submission in the 18th January 2010 CEC of the Confederation. Now, the Chandigarh CAT, Haryana High Court, the Principle CAT have delivered judgment in favour. The Hon’ble Supreme Court dismissed the SLP filed by the Government on the matter. Now the case has been sent to the Confederation for taking appropriate decision so that the benefit of these judgments may get to all Central Government Employees.
The meeting congratulated the Association for bringing & popularizing the issue through Association web site. It has decided to pursue the matter through Confederation by the GS being attended the Confederation Secretariat meeting regularly. 

  
9.
Grant of Rs. 4200 Grade Pay to UDCs on completion of 5 years service

DoPT vide O.M. No.20/49/2009-CA.II(B) dated 22nd June 2011 ordered upgradation of 30% UDC of Central Secretariat Staff (CSS) to Rs. 4200 grade pay after completion of 5 years on the post.    In this respect Confederation has passed a resolution in the Kolkata Conference and pursuing.
The meeting observed that the recruitment rule, mode of appointment etc of UDC in all Central Government Offices is similar. Thus limiting the upgradation of 30% UDC post for CSS only is against natural justice. And decided to pursue the matter further.

10.
Change of recruitment rule of Assistant to grant promotions to UDCs, completed 18 years combined service in the cadre of LDC & UDC

Consequent on our request FOD has sent the recruitment rule of the Assistant on combined seniority of LDC & UDC and the Ministry of Statistics has recommended accordingly. But it is learnt that UPSC has disagreed the proposal and accordingly the recruitment rule accepted without considering the combined seniority. Now, the Association is trying to get relaxed the qualifying period of promotion of UDC to Assistant as a onetime measure so that all the vacant posts of Assistant may be filled up. It has also come to know that UDCs have to undergo an administrative training to qualify for promotion to the post of Assistant.
 
 Meeting discussed the matter and decided to take up the matter for relaxation as a one-time measure so that the vacancies of Assistant may be filled up immediately. It has also decided to take action for early filling up of all the vacant posts in Admn branch.

                      
11.
Filling up of all vacant posts of Administrative Staff

Decision/Action
Around 50 posts of Assistant are lying vacant in various FOD Offices. It is learnt that UDCs with required qualifying service are not available to fill up these vacancies. Similarly, it is come to our notice that due to non availability of LDCs with required qualifying period some posts of UDCs are lying vacant in some Regions. Measures are being taken at FOD level to fill these posts with relaxation of qualifying period. Large numbers of LDC/MTS are lying vacant in various FOD Offices. These posts are not being filled up due to the inability of the SSC in supplying dossiers. However, FOD has allowed the FOD Offices to engage retired persons/or person on contact basis as against these vacant posts till the SSC nomination is done.
 
 Meeting discussed the matter and decided to pursue the matter at Association level so that these vacancies may be filled up immediately.
    
     
12.
Appointment of MTS, passed the Departmental Examination, to the post of LDC

Decision/Action
A resolution for filling up of vacant posts of LDC by educationally qualified MTS was adopted in the Mumbai General Body Meeting and the matter was taken up with the FOD. Accordingly a proposal for relaxation of the rules as a onetime measure was sent to the Ministry. But the proposal learnt to be not accepted as yet. Now during the General Secretary’s visit to FOD Hqrs in the month of January 2013 a proposal for promotion of all MTS who has cleared Departmental Examination was put up and the same is under consideration of the FOD. 
The meeting unanimously endorsed the action taken by the Association. However, it has decided to keep our efforts for the promotion of educationally qualified MTS to the vacant post of LDC as one time measure.

13.
Formation of Subordinate Administrative Service

Decision/Action
By initiating discussion on the item the GS has said that Staff selection Commission conducts examination for the post of LDC and supplies the dossiers to various Departments of Central Government. But due to lack of sufficient promotional channel the LDC appointed in many of the Departments do not get promotion timely as a result they retires without having any remarkable achievements. On the other hand in majority of the Departments LDCs appointed get frequent promotion and as a result they retire in a much higher post with respectable pay structure. We feel it is high time to put up a proposal for constitution of a subordinate administrative service for the various subordinate offices of the Central Government. It will help the administrative staff timely promotion as well as chances to gain experience in intra departments
 The meeting appreciated the move And approved the proposal unanimously. It has decided to take up the issue to the Government immediately.
    
14.
7th Pay Commission.

Decision/Action
GS has explained the Confederation’s continuous efforts for the constitution of 7th Pay Commission w.e.f. 1.1.2011. He cited the huge participation in 26th July 2012 Parliament march and 12/12/12 strike in which l0 lakhs Central Government Employees have participated. The GS, who is the National Auditor of the Confederation, also, has said that Confederation has succeeded to win over the Railways & Defence Employees on this issue and accordingly a Joint action Committee has been Constituted. Now it is the Joint Action Committee’s efforts to persuade the Government to constitute the 7th CPC immediately.
 The meeting unanimously endorsed the action taken by the General Secretary. However, it has decided to keep our efforts for the promotion of educationally qualified MTS to the vacant post of LDC as one time measure.

Association web site.

General Secretary informed the meeting that the Association web site www.aiamshq.blogspot.in  is rated among the leading web sites of the Central Government Employees Associations in the country. Though the web site was created in April 2010 the viewer ship till 2012 was meager. But taking up of the common issues of the upgradation of grade pay of LDC & UDC, Hierarchical MACP, posting of latest Government orders, court orders etc popularized it amongst employees of other Central Government Departments. In this way, now the Association web site became the web site of all Administrative Staff of Government of India Offices. Various popular web sites of the Central Government Employees including the 90paise.com re-produce several of the posts of our web site due to the popularity of the issues taken up by us. As a result the average viewer ship of our web site increased many fold.
 Meeting appreciated the efforts made by the General Secretary to bring the burning issues of the Administrative Staff in the forefront. Meeting observed that the Association web site become a platform for the entirety of the Administrative Staff of the Government of India Offices. It has decided to continue the Association web site as a common platform for the struggle for genuine demands of the Administrative Staff.

16.
Financial Review

Decision/Action
The GS has informed that the annual contribution of the Association has not been deducted and sent to the Association by the Offices since any directive in this effect was issued by the Ministry/FOD. In this respect, office has said that they deduct the Annual Contributions of recognized Association only. Resultantly financial shortages for doing day to day activities of the Association occurred. Thus till the recognition is granted, Units should collect contribution at their own level and send it to the Association Head Qrs., the GS said.
 Meeting discussed the issue in details and decided to direct all  Units to collect contribution at their level and deposit the amount in the Bank Account as given by the GS. GS will maintain the account of the fund received and details of the same will be circulated amongst the Units.

The meeting was presided over by Smt. V.D. Bhatkar, Working President of the Association.

    Why the matter of up gradation for Stenographer Grade-III (re-designated as Steno Gr. II) is excluded in this demand who are also working in non-Secretariat Department . Sir, as per . DoPT vide O.M. No.20/49/2009-CA.II(B) dated 22nd June 2011 ordered up gradation of 30% UDC/Stenographers Grade 'D' of Central Secretariat Staff (CSS)/CSSS both the cadre were up graded with 4200/- Grade Pay after completion 05 years regular service in 2400/- G.P. It is noticed that the benefit of up gradation of grade pay is only for UDC not for stenographers. Why this cadre is excluded? They are also in G.P. 2400/- Sir, this demand should be placed for up gradation both the cadre of Stenographers/UDCs.
    I shall be highly obliged if this demand will be included in JCA's meeting.

  2. In fact DoPT has ordered upgradation of 30% posts of UDC and Stenographer Grade D after completion of 5 years service to Rs. 4200 grade pay. The matter has been raised in the Confederation's National Executive by this Association and demanded its implementation in the subordinate offices also. Since the stenographers are not the members of this Association, we have not mentioned their name in the minutes of the CEC despite of the fact that the stenographers will also be the beneficiaries in case the demand is accepted. Similarly, this Association has been demanding the upgradation of the grade pay of the LDC & UDC to 2400 & 2800 respectively. Here every stenographer should know that the upgradation of the grade pay of LDC to 2400 will have the consequent effect of the upgradation of the grade pay of Steno Grade D to Rs. 2800. Hence they will get Rs. 4200 grade pay as 1st MACP. Thus do not get worried over not including the name of stenographers in the minutes of the executive meeting of our Association. Please do support us in our work for the welfare of entire Administrative Staff in the Central Government Offices especially in the subordinate offices.
