  9. Gautham Pal sir itis not necessary that each and every time we need to go for CAT for similar cases........there are many court verdicts where court has clearly stated that judgement is applicable to all similar cases even though the incumbent is not a part of applicant.........

  10. Nagrajan sir I understand your logic but as it is an oral order authentication is needed very much when any one or a group of people representing their respective authority. As it was stated in a earlier post by Suresh Negi I have search the site of CAT Principal Bench for having a copy of the same but it is not available. I have also the searched the order of CAT Chandigarh Bench. Therefore, we need a authenticated copy to present the same before the authority only. That does not mean I have not relied upon which has been posted above. Therefore please help us.

  11. I got promotion to the post of UDC w.e.f 01.12.1995 and I have been granted MACP (Last) w.e.f 01.9.2008 and with my fixed at grade pay of Rs.2800/-. Why I had not been fixed at grade pay of Rs.4200/-. At present I have completed more than 18th years of service on the same post i.e., UDC. CAT Principal Bench, New Delhi OA No.904/2012 dated 26.11.2012 has been posted where it has been mentioned that MACP will be awarded according to Promotional hierarchy not next Grade Pay (.) Sir, kindly if it is possible kindly highlight this matter to us because we are eagerly waiting for you reply (.) Thanks.

  13. Sir, I joined on 25.09.1989 as LDC. I got ACP on 25.09.1991 in the Scale 4000-100-6000 i.e. UDC scale. I got 2nd MACP on completion of 20 years i.e. on 25.09.2009 with grade pay Rs. 2800/- . Now, my question is I should be benefited with the order of CAT Chandigarh Bench though I have not got any promotion.

Sir, there are a lot of people in our department who have been deprived their legitimate promotion because of the lopsided and biased nature of our management and they have been in the post of UDC (equivalent) for the last twenty years without any respite either by way of promotion or MACP. It would be a great service to them if we are able to bring in the MACP based on heirarchial grade pay. Atleast they can retire with some dignity.

    Sri. Pillai Sir, first I would thank you for this great effort. You are informed that this matter was discussed in the meeting of confederation on 22-07-2013. Still you are waiting for taking this matter to the highest level/DOPT. Now my opinion is that LDC/UDC are waiting that the Govt. or DOPT is taking action in this regard. According to my view, the Govt/DOPT will not take any action because the No of LDC/UDC are more. Kindly take this matter with appropriate level. other wise kindly give the guidance to file a cese before the CAT, Bengaluru. This is my humble request in favour of all LDC/UDC's of our nation.

  17. Pillai sir thanks a lot. You are the one person looking in this matter and rest of the associations/union/leaders are interested in technical category employees problems, Gr. Pay and Pay Band. When a 12th and diploma ( Pharmacist) studied are getting 2800/-GP and after 2 years they also get Gp.4,200/- but post graduate LDC/UDC are getting 1900/- GP and there is no chance of promotion for next 20 years. After 10 years 100/- is enhancing for grant on MACP. Whether it is a justice. Now my suggestion is that you may brought the same to the PM because the only person who is having the GUTS to write to the PM apart from all the association/unions/ leaders.

    1995(4000-6000), THEN DEPTT. GRANTED ME 2ND ACP FROM SEPT 2009
    (AFTER COMPLETION OF 24 YEARS OF SERVICE)WITH GP Rs.4200/- BUT AFTER
    2 MONTHS CANCEL MY 2ND ACP AND GRANTED MACP FROM SEPT 2008 WITH GP
    Rs.2800/- THIS ORDER HARM ME FROM BOTH SIDE AS GRANTED 2ND MACP AFTER
    MY 23 YEARS OF SERVICES, AND LOWERED GP FROM 4200 TO 2800. NOW COMPLETED APPROX 28 YEARS OF SERVICES AND DRAWING GP 2800/-

  24. Dear Com. Pillai it is come to my knowledge that concerned department forwarded the CAT judgment and Supreme Court SLP to DoP&T for administrative approval. But I am not sure about this fact at all however I think for more information we may ask DoPT through RTI about the status of the case otherwise individual department may represent through their administrative ministry by quoting the said Judgment and a uniform action may be taken in this regard.

  28. Hi All,
    I am one of the applicant in Case No. 904/2012 for granting second MACP of Rs 4200 instead of Rs 2800. The CAT Principal Bench, New Delhi admitted my plea, but the DoPT has been denied. And a case challenging CAT PB orders has been filed in Delhi High Court. The Next Date of hearing is fixed on 11th Nov. 2013, although the decision CAT chandigarh & High Court (Chd) has been allowed for granting MACP by the Supreme Court. However, there may be some delay but will definitely be granted.

      CAT PB order in Case No. 904/2012 is already posted above in this webpage. However, Mr. Raj Pal of Chandigarh has got grade pay of Rs 4200 as per CAT Chd., High Court and govt. appeal against this order was dismissed by supreme court. The details of Raj Pal order is not available with me, but contents of Raj Pal case are mentioned in CAT PB judgement.

    3. Hope Monday 11.11.2013 will bring happyness in the life of ldc/udc of Central Govt. by allowing macp on hierarchy and not on next grade pay by High Court, Chandigarh. Please inform us the details whenever you will get the information.

    Thanks a lot. This Court Order should be made applicable to all LDCs/UDCs working in the subordinate offices of the ministries. Since it is a common anomaly, the DOPT should consider this Hon'able Court Order as a general and extent the benefit to all LDCs/UDCs working in the sub-ordinate offices of the ministries to remove this anomaly for ever.

  30. It is govt. duty to clear a genuine anomaly of LDC's/UDC's to increase their efficiency which is decreased due to 6th Pay commission loss. Dear Sir,Pillai ji we all are very thankful to you for your efforts to raise our demand in a line for us those working in the sub-ordinate offices of the ministries.This govt.& their officer's are blind as ANDHAA BAANTE REWRI APNE APNE KO DE. they misuse the staff and looted them by giving them Rs. 100-100 after 10 yrs. service. this is when our Hon'ble Prime Minister is very honest in all respect.

  32. AFTER THIS LANDMARK JUDGEMENT, I KINDLY REQUEST THE GOVERNMENT TO HELP US BY IMPLEMENTING THIS JUDGEMENT OF CONSIDERING PROMOTIONAL HIERARCHY IN PLACE OF GRADE PAY HIERARCHY WHICH WAS NOT BENEFICIAL TO MANY OF THE CENTRAL GOVERNMENT EMPLOYEES.

    I AM SURE OUR GOVERNMENT WILL CONSIDER THIS JUDGEMENT IN THE BEST INTEREST OF ALL CENTRAL GOVERNMENT STAFF.

  33. Pillai sir thanks for your good efforts to bring the pay anomaly of "LDC,UDC" in the lime light. Sir it is requested to analyse and study comparatively the "ADMIN CADRE" (LDC,UDC, OS, AO OR CGO)with reference to promotional avenues available to the "ADMIN CADRE", thereof pay scales recommended from time to time by various pay commissions with other "CADRES". Sir we poor LDC/UDC's are not able to represent our genuine problems pertaining to our cadre at appropriate level, we are working with full dedication, devotion to duty and honestly earing good name in the sub ordinate offices in the Govt. and my experience speaks that we are the real pillars of the "ADMINSTRATION". We request u please pursue our case in the light of natural justice.

  35. Two meetings on MACP have conducted so far and one more meeting is taking place in due course may be this month. In the earlier two meetings on MACP, the official side outrightly denied to grant promotional hierarchy in place of grade pay hierarchy. With this outcome of reported judgements, DOPT should reconsider the plight of large number of deprived categories such as LDCs, Stenos etc., Let us unite and struggle for the genuine cause.

  36. All Central government unions/federations should mount pressure on the DOPT to replace the heirarchical grade pay clause in the MACP rules with promotional grade pay, or else everyone affected by this anomaly will have to run to the court to get his due.

  37. As said by Rawatji, all central government unions should mount pressure on the DOPT which is a nodal agency for implementing MACP for all ministries. Else, all employees should unitedly approach CAT duly drawing the earlier judgements to get their benefits.

The DOPT OM dated 19.5.2009 clearly says " The MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section 1 , Part-A of the first schedule of the CCS (Revised Pay) Rules, 2008. Thus, thegrade pay at the time of financial upgradation under the MACPS can, in certain caseswhere regular promotion is not between two successive grades, be different than what is
    available at the time of regular promotion. ln such cases, the higher grade pay attached
    to the next promotion post in the hierarchy of the concerned cadre/organisation will be
    given only at the time of regular promotion"

    So it was clear that the MACP is to be granted to next grade pay only. AS per CAT order (OA No.904/2012) they have interpreted the word 'hierarchy' as promotion hierarchy where the DOPT OM clearly says 'hierarchy of recommended pay scale as given in Section of Revised pay Rules."

    The present CAT order would lead to anomolous situation as there shall be no uniformity in granting MACP. Official working in certain organizations where the promotion channels are to higher grade pay will only benefit. This will bestow undue benefits.

  40. Parameswaran says promotional grade pay in MACP will bestow undue benefits. One LDC after completing 10 years regular service will get Rs.100/- in GP whereas to reach 2400 GP he has to complete 20 years service. But in ACP after completing 12 years service he got the promotional scale/grade pay. Hence MACP should be equal or more beneficial than ACP. So the CAT has given right decision to give MACP in promotional GP. Pay Commission recommendation should always be beneficial to employees.

  41. The govt. will not take any action at resent. The officers of DOPT are blind and not hearing to the voice of LDC/UDC/Associations/Confederation/Unions etc., Hence I request all LDC/UDC to sent request letter to DOPT to announce the date of Anomaly Committee Meeting/JCA Meeting immediately as the case when the Telegram was sent at Last year. At present the Telegram facilities is not available. The Leaders should think in this matter and announce to date for sending the request letter at the earliest.

  42. I was appointed on 12-10-1984 as LDC. Thereafter, promoted as UDC w.e.f. 4-5-1998. I got ACP after completion of 24 years of service w.e.f. 12-10-2008 in the next promotional grade of Head Clerk i.e., 5000-8000. Initially, the implementation of 6th CPC I was placed in the revised pay scale of Rs.9300-34800 + Grade Pay Rs. 4200/- but subsequently on the implementation of MACP, my organization has disallowed the benefit of Grade pay Rs.4200/- and allowed Grade pay @ Rs. 2800/- only. Now completed 29 years of service and drawing GP 2800/-

After completion of 30 years of service on 24.12.2010 I got III MACP and granted 2800/- of GP. For your information Sir, I have look after all UDC's sections also and now in cashier for the 5 years. My date of retirement of service is 10/2016. I have not get any promotions for the past 24 years. I request U kindly pursue my case and in the light of nature and inform me at the earliest.

  45. Hotchpotch in grant of financial up gradation under revised MACP scheme for Survey stream professionals at GSI, NR, Lucknow has put them in fix. Absence of adequate knowledge, immunity towards directives of superior authorities, stubborn and biassed mindset has been main hindrance to resolve the deadlocked situation. Grant of due financial benefits under revised MACP scheme at all the offices of Geological Survey of India, barring Northern Region office is just exposure of administrative fallacy.
