MACP ON PROMITIONAL HIERARCHY
Case No  21803/2014
Some of our friends are seems to be confused over the advance listing of an MACP case, which had to be heard today. These cases are not related to the main case of MACP i.e. M V Mohanan Nar V/s Union of India. The fact is that some cases pertaining to CAG Employees’ was attached with the main case of MACP. Since these cases are related to anomaly, the respondents (CAG Employees) had urged the court to detach their case from the case of MACP. Meanwhile Amicus Curiae, in his report, termed the CAG Employees' case as separate from the MACP and recommended to hear separately.  Considering this, the court had decided to hear the CAG employees' case separately, even though it was not detached from the main case, and ordered to list the case on 28th January.  The argument on the MACP case was completed on 23/01/2020. The delay in completion of argument of CAG employees’ case is appeared to be delaying the final judgment of MACP case also.   The CAG employee’s case has to be listed today 2 PM; but it has not been listed. And now it has come to know that the CAG Employees’ case is being detached from the MACP case. If so the decision on MACP case may come within one week. Let us wait.

  3. If this decision comes in favour of Govt. Servants and government issues orders urgently for the implementation of this, will definitely goes in favour of BJP in the forthcoming assembly elections of Delhi.

It is the most biased judgement against the central govt. employees, especially below Group A. the judges relied everything that is against the junior employees. if this is the judgement that they want to deliver why did they wasted 6 years. they could have dismissed the case on the first day itself. it is only to make fool of every junior Govt. employees. In am very sorry, agrieved and disheartened with the judiciary once again.

If the ACP of 5th pay commission resulted in interdeartmental disparities, the MACP of 6th pay commission casused intra-departmental and even created a huge gap between ACP & MACPs which cannot be bridged for ever. one wrong observation was a junior superseding the senior -is never possible in MACP. court wrongly upheld the MACP OM in which it was stated that the difference in pay scales on account of financial upgradations under the ACP scheme and MACP would not be construed as anamoly- which is apparently an anamoly and known by the authors before its decision. there is no such thing like stringent DPC in case of ACP as compared to steering committee in case of MACP. MACP caused huge loss to the employees of below GROUP A in comparision to Group A and above as there is no difference between promotional hierarchy and hierarchy of grade pays in case of Group A posts. the court could not find best work done by the 5th pay commission and its entire spoilage by subsequent pay commissions. cadre re-structuring will never be implemented in case of isolated posts and there is no other remedy except ACP/ MACP on promotional hierarchy.

  13. successive pay commissions arbitrarily upgraded pay scales of many posts, was that a scientific or rational. they have lifted certain categories from the below and left othters at the knock bottom. why the could not appreciate this. people go to court for justice, but if the same court is biased whom can we complain.

  14. India has to go a long way to be matured democracy as most of the people sitting in the power still feudalistic and can think of only for the benefit of elite.
